SECOND AMENDMENT TO

DECLARATION OF COVENANTS, CONDITIONS, EASEMENTS AND RESTRICTIONS

OF

SHADDOCK ESTATES

THIS AMENDMENT is made this 30th day of August 2007, by SHADDOCK ESTATES HOMEOWNERS ASSOCIATION, Inc., a Florida corporation (the "Association").

WITNESSETH:

WHEREAS, J. B. & D., INC. AND ASSOCIATES, a Minnesota Corporation (the "Declarant"), caused that certain Declaration of Covenants, Conditions, Easements and Restrictions to be recorded on March 27, 2002, in the Public Records of Polk County, Florida, in Official Records Book 4962, Pages 2148; et. seq. (the "Declaration"); and

 

WHEREAS, Article IX, Section 3 states the covenants, conditions and restrictions of the Declaration may be amended by a two-thirds vote of the Association Members and the association may effect such an amendment by having its approved officers execute and acknowledge an appropriate amendment and file the same for record in the office of the Clerk of Court, Polk County, Florida; and

WHEREAS, the membership authorized amending this declaration by written consent; and

WHEREAS, the Association, as defined in the Declaration, now wishes to amend this Declaration in the following respects.

NOW THEREFORE, the Declaration is hereby amended to read as follows:

  1. Article V, Section 9 of the Declaration is amended to read as follows:

Section 9. Fences.

Privacy walls are prohibited. Privacy fencing shall not exceed six (6) feet in height. Fencing, other than privacy fencing, shall not exceed four (4) feet in height. No fences or walls shall be allowed in front yards. All fencing must be approved by the Association prior to installation and shall not be in violation of County ordinances. In general, fences are not encouraged within Shaddock Estates. Hedges, berms, or other landscaping alternatives are preferred.
