Stallion
Service Contract
This certifies
_____________________________________ , hereafter referred to as mare owner,
has engaged one service to Senfully Awesome for the mare
_________________________________________, Reg. No. ______________________ for
the 2007 breeding season at $650.00(USD). Samantha Knight, the manager for the
above named stallion, will herein be referred to as breeder. The above named
mare will be stabled at _________________________________________, in
_________________,____, for the duration of her breeding, herein referred to as
the Breeding Farm.
1. A booking fee of $150.00 is payable with this contract and the balance of $500.00, plus all unpaid expenses will be payable upon receipt of an invoice or when the mare leaves the Breeding Farm, or prior to shipment if shipped semen is needed, whichever is first. In the event breeding is purchased through a stallion service auction a $150 non refundable chute fee is applicable for all contracts. The Breeder requires 48 hours advance notice when the Mare Owner wishes to remove their mare (s) from the farm. This will allow sufficient time to prepare the final statement so the Owner may settle their account. The Booking fee is non-refundable.
2. A photo copy of; registration papers (both
sides), OLW test results, a veterinarian's health certificate, including
breeding soundness, uterine culture,
worming and immunization records, are required upon return of this contract. If
these are not submitted with the contract, the Breeding Farm shall have a
veterinarian make proper tests and evaluations at the Mare Owner's expense. Flu,
tetanus and rhinopneumonitis vaccine must be given before the mare arrives. A
current Coggins test shall be furnished upon delivery of mare to the breeding
farm.
3. The Mare Owner shall agree that each mare
offered for breeding shall be in sound breeding condition and free from
infection or disease. If any mare appears not to be in sound breeding condition
the mare will be evaluated by a veterinarian at the Mare Owners expense. If the mare is confirmed by a veterinarian
not to be, in their opinion, in sound breeding condition, the mare shall not be
bred. Mare Owner may substitute another
approved mare within that breeding season.
4. The Breeder agrees to diligently try and
settle the above named mare and shall have sole discretion of determining the
best method of breeding such mare. If however, the mare does not settle, the
Breeder and Breeding Farm shall be held harmless.
5. Live Foal Guarantee. Live foal means the
foal shall stand and nurse. It is understood that if the mare proves barren,
aborts her foal or if the foal is stillborn, a return season will be guaranteed
the following year only, providing proper notification is given. Proper
notification shall be defined as follows: Written certification by a licensed
veterinarian within seven days that the mare has slipped or produced a
non-viable foal. Mare Owner certifies that such abortion or death did not
result from any act or omission of the Owner subsequent to the mares departure
from The Breeding Farm. In the event that a Lethal White foal the Mare Owner
must provide proper notification within 7 days of the birth of the foal, Mare
Owner may rebreed during the current season for a chute fee of $150. In the
event that said mare cannot be rebred in the current year because of
extenuating circumstances, transfer of the rebreed to ONLY the following year
will incur an additional $50 fee. Should the mare owner request this option,
the stallion owner must be notified of the reasons for this request with in 2
weeks of birth. A breeders certificate will be issued to mare Owner after all
expenses have been paid in full and upon notification of birth of the foal.
6. Color Foal Guarantee: If the
resulting foal is not eligible for regular paint registry, the mare may be
rebred in the current season, provided a chute fee of $150 is paid. In the
event that said mare cannot be rebred in the current year because of
extenuating circumstances, transfer of the rebreed to ONLY the following year
will incur an additional $50 fee. Should the mare owner request this option, the
stallion owner must be notified of the reasons for this request with in 2 weeks
of birth. A breeders certificate will be issued to mare Owner after all
expenses have been paid in full and upon notification of birth of the foal.
7. Waiver of Liability. It is understood that
the Breeding Farm, its owners, employees, veterinarians, and guests shall not
be liable for any injury, escape, disability, or death of any horse on its
premises. The above named Mare Owner, whose horse (s) are under the care of The
Breeding Farm will not be liable or responsible for any damage, injury or death
to the breeding farm stallions, employees, veterinarians, or other animals in their
care whether or not caused by his horse.
8. The breeding season shall begin February 1st
and close July 1st of the year covered by this contract. It is
further agreed that should the above named stallion die, or become unfit for
service this contract will become null and void. If the above named mare dies, during the
breeding season then the Mare Owner may substitute another approved mare.
9. Orders for shipments are filled on a
first come, first served basis. The mare owner is responsible for shipping
charges for cancellations received after shipment has already been sent

returns one copy of this contract to the Breeder it will then be a binding
contract on both parties, subject to the terms and conditions within this
