Here is Mr. Evan's letter in response to why we can't get our tax write-off on the fraud:

At this stage, it does not appear we will be in a position to issue any documentation for IRS purposes. We are trying to have a dialogue with the IRS on the subject, but so far that has not been fruitful. We are hopeful we may get some guidance we can pass along, but I would not count on it. It will be some months before we can define the exact loss, and that, we understand, is the criteria the IRS is looking for to allow the loss write off. Not a logical position I would argue. Your tax advisor should be relied on in this regard.

The wheels of justice have been turning very, very slow in the Heath case. We suspect that nothing of consequence will start happening again until after the convictions. Meanwhile, check here News Articles for the latest news articles which Robb Evans is posting. Many of them are from Riverside County's Press Enterprise, but we notice he is not putting all related news article up there. We have not seen an L.A. Times one yet.

Daniel Heath and Schlarmann each face 402 felony charges and up to 167 years in prison if convicted, said deputy district attorney Mike Silverman. John Heath and O'Brien each face about 77 felony counts and up to 61 years in prison if convicted, according to sentencing guidelines provided by Silverman. Bail for each of the four is set at $144 million - the amount the district attorney's office says Heath & Associates illegally brought in from now over 1600 seniors.

From May 19, 2004: "I work in the investment industry, which is undergoing a major SEC investigation in general, and the fines the feds collect are kept by the feds. If the person has nothing left after the feds take their cut, the victims of scams get nothing. It sucks, and Congress needs to be lobbied to have the proceeds of fines for wrong doing in investment and such distributed to the victims on a percentage participation. This is yet another example of people getting screwed royally by a scammer and getting screwed again by the government. This is exactly what happened to those Enron employees and retirees. Please make sure you give a Victim Impact Statement to Judges whenever there is a trial. When the criminal charges do go before a criminal Judge, pushing for Victim Impact statements will ensure that the Heaths and Schlarmann do not get parole, but that they end up in Federal prison with Bubba as their cellmate, no doubt. :-)
