| Ferretti v. Berry, 189 A2d 344 (1963). A nine year old bicyclist hit a stone lying near a hole in the road. Both the boy and his 22 inch bicycle fell in the hole. The next day the boy had surgery to remove a ruptured spleen. The court quoted G.L. 1956 sec. 24-5-1 and held the hole in this case would have endangered those travelers provided therein: "All highways, causeways, and bridges, except as is hereinafter provided, lying and being within the bounds of any town, shall be kept in repair and amended, from time to time, so that the same may be safe and convenient for travelers with their teams, carts and carriages at all seasons of the year, at the proper charge, and expense of such town, under the care and direction of the town council of such town." | ||||
