Gagnier v. Fargo, 11 ND 73, 88 NW 1030 (1902).  Insofar as a municipality may permit or not prohibit sidewalk cycling, those municipalities are obligated to make those sidewalks safe for pedestrian users; what is dangerous to a bicyclist is not necessarily dangerous to a pedestrian, and bicyclists assume the risks as to conditions in sidewalks which are safe for pedestrians.  [Further briefing and analysis may be available in the future.]
