| Davis v. City of Cohoes, 516 NYS 2d 358 (1987). A 2 1/2 year old tricyclist riding on a sidewalk tried to turn around, lost his balance, fell down the embankment upon which the sidewalk was located, and was injured. The City's motion for summary judgment was denied, and they appealed. The Supreme Court, Appellate Division, Third Department, affirmed. | ||||
