| Dix v. Old Colony St. RY Co., 89 NE 109, 202 Mass 518 (1909). The plaintiff was riding a bicycle between 8:30 and 9:00 on a dark night in October, and rode into an area where a lighted barrier guarding a sewer trench had been removed. The bicyclist fell into the trench. The defendant's failure to act with due care would have endangered ordinary users. Verdict for plaintiff, defendant's exceptions overruled. | ||||
