| Clinton v. Town of Revere, 80 NE 813, 195 Mass 151 (1907). Use of a bicycle does not prevent recovery for injuries from a defect in the street, if the bicyclist was using ordinary care at the time. A bicyclist riding on the road attempted to pass a wagon on the right, hit a "gully" and was injured. The law required drivers of vehicles to pass other vehicles traveling in the same direction to the left, but whether the bicyclist's conduct was reasonable and prudent was a question of fact for the jury. Judgment for plaintiff, defendant's exceptions overruled. | ||||
