EXECUTIVE AND JUDICIARY

 

 In areas where, the executive or legislative limbs of the Government have to act, the court shall refrain from encroachment.  It is entirely a matter for the executive branch of the Government to decide whether or not to introduce legislation. Appointment of Minister - Choice of Chief Minister - Does not command Judicial tolerance or even demand judicial  scrutiny.  [Kallara Sukumaran v. Union of India, 1987 (1) KLT 226 = AIR 1987 (Ker) 212 (DB), Malimath (CJ) & Bhaskaran Nambiar (J)]
