Charter of The Benacian Commonwealth

 

Article I.  The Benacian Council

            Section A. Powers of the Council

                        The Benacian Council has the power to sign treaties, form alliances, appoint ambassadors, declare war recognize nations and admit new members. 

            Section B. Voting percentages.

                        Treaties and alliances must pass by a 2/3 majority.  A 50% +1 majority is needed to appoint ambassadors.  Votes to declare war upon a nation must pass by a ¾ majority.  A 50% +1 majority is needed to recognize and unrecognized a sovereign nation. 

            Section C. Council member

                        Council members represent the individual member nations of the Commonwealth.  One council member is chosen by each member nation to the Benacian Council.  A council member may only hold one seat on the council at any given time.  Council member serve a term of one month.

            Section D. Chairman of the council

                        The councilmen themselves elect a chairman of the council from among the council.  The chairman has the power to call council meetings and preside over them.  The Chairman tallies votes in the council and has the power to break any tied votes.

 

Article II.  Addition of New Member Nations

            Section I

                        For a nation to join the commonwealth it must be accepted by 3/4 of the council and agree to follow the charter of the commonwealth without exception of alteration. 

            Section II.

                        Any nation may choose to leave the commonwealth.  If they leave, they forfeit all rights, powers, and protections of membership.

 

Article III.  Declarations of War

            Section I. Restrictions on declarations of war

                        The commonwealth can only declare war if it's attacked first or is obliged to enter into combat by a treaty. 

            Section II.  Police Actions

                        Should a member nation be attacked and there is insufficient time for a council meeting to be call, the member nation may declare a state of emergency and declare a police action, for 24 hours or until a council meeting can be called, against the aggressor nation or group. 

            Section III. Supreme Allied Commander

                        The militaries of all Commonwealth nations report to the Supreme Allied Commander who is appointed by the Council.

 

Article IV.  Rights of Commonwealth citizens

            All citizens of the Commonwealth are entitled to freedom of opinion, religion and the right to defend themselves in court.

 

Article V. Disputes between member nations

            Should member nations get into a dispute, the dispute will be mediated in a Council meeting by a neutral member nation.  Should no neutral member nation be available, a natural third party nation may be chosen by the disputing nations.

 

Article VI.  Amending the Charter

            Any change to the Commonwealth Charter must be approved by 66% of the total Commonwealth Citizenry that casts a vote to change or not change the charter.

 

Article VII. Ratification of Charter

            In order to ratify this charter it must be signed by the representatives of the three founding nations.  In addition two advisors to the council may sign.
