At the discretion of my executors, nothing doubting but at the general resurrection, I shall receive the same again by the mighty power of God.

Secondly, I give these abstracts to the people who use them hoping that the revealing facts therein will be helpful and gratifying, and that generations yet unborn will find this useful.

on the Public Domain and the acts supple arental thereto the claim of Elizabeth

Pickering has been established and duly consumated in our county to earn for

North half of the North East quarter of section nineteen and the North half

of teh Northwest quarter of section twenty in Township three South of Range

Thirty two West of the Fifth principal meridian in Arkansas containing one

hundred and sixty acres.

According to the official plot of the survey of the said land returned to

the General Land Office by the Surveyor General;

Elizbeth Pickering the tract of land above described. To have and to hold the

said tract of land with the appurtenance whereby unto the said Elizabeth

Pickering and to her heirs and assign forever.

Services held for Wapnucka man here H.B.Pickering, 68-year old Oklahoma

pioneer, was buried last week in Stringtown cemetery following hs death at hs

home in Wapanucka.

Born at Cove, Arkansas, in 1882, Pickering came to Oklahoma about the time of

statehood and lived in this area for the remainder of his life.

He was a member of the Baptist church.

Services were conducted by Rev. Harold McGlamery and Rev. W.H. Goss in Atoka.

Survivirs include his wife, Jincy Pickering of Wapanucka; fve sons, Sam

Pickering of Galveston, Texas; and Ben, Elmer, Odus and Aaron; five daughters,

Mrs. Eldorado Evans, Mrs. Thelma Pitmon, Mrs. Delphia Bowland, Mrs. Elizaeth

Davis, and Mrs. Lima Jean Wiles of National City, Calif.; three sisters, Nola

Mayabb of Guthrie, Mrs. Matilda McMillan of Colgate and Mrs. R.E. Fitzwater of

Atoka and one brother, J.L. Pickering of Singeton, Texas.

Comes now the plaintiff and for his cause of action against the defendant,

alleges and states:

That he is a resident of the State of Oklahoma, and has been resident for

more than one year prior to filing this petition, and is now a bona fide

resident of Atoka County, Okla.

That plaintiff and defendant were legally married on the ____day

of____1900, at Thomasville Oklahoma, and by said marriage the following named

children were born, to-wit: Sam, Robert Ben, Elmer, Odis, Elderado, Thelma,

Dephia, Pete, Lizzie, Arron and Lima Jean Pickering.

Plaintiff further states that said defendant is quilty of desertion and

abandonment; that on or about the 27th day of December, 1936, defendent

deserted, left and abandoned plaintiff without cause or provocation on his

part, and since said separation they have lived wholly apart from each other,

and more than one year has elapsed since said separation.

Plaintiff further states that he has at all times dur-

his marriage to defendant acted as a faithful husband and is without fault in

the premises.

Now, on this the 28th day of March, 1939, a regular judicial term of the

January 1939 term of this court, this cause coming on for trial in its regular

order before Hon. Roy Paul, District Judge, the plaintiff appearing in person

and by his attorney, Gilbert W. Daney, and the defendant appearing not, and the

plaintiff announces ready for trial, and the court after duly examining the

files, pleadings and services herein, and being otherwise fully advised, and

after hearing testimony of witnesses, sworn and examined in open court, finds:

That all the material allegations contained in plaintiff's petition are

true; that plaintiff at the time of filling her petition herein had been for

more that one year prior thereto, a bona fide resident of the State of

Oklahoma, and is a resident in good faith of Atoka County, Oklahoma, and that

the parties hereto have been legally married at the place and on the date as

alleged in plaintiff's petition, and that of said marriage the following named

children were born to them, to-wit: Sam, Robert Ben, Elmer, Odis, Elderado,

Thelma, Delphia, Pete, Lizzie, Arron, and Lima Jean Piekcering, all of whom are

now in the care and custody of the defendant, who is residing out of the State

of Oklahoma.

The Court further finds, that the defendant has been duly served with

notice of the pendency of this action; that she has filed herein her waiver,

waiving the issuance and service of summons upon her, accepting service and

entering her general appearance herein, and further states in said waiver that

she is willing that this cause be tried a anytime convenient to this court and

without further notice to her, and said waiver and appearing being duly filed

herein and made a part of this proceedings, and now, said defendant has failed

to appear, and failed to object or deny in anyway the petition of plaintiff and

is therefore declared wholly in default, and that by reason thereof plaintiff's

petition as a whole should be taken as confessed.

The Court finds further, that defendant is guilty of desertion and

abandonment as alleged in plaintiff's petition; that the parties hereto have

lived wholly separate and apart from each other for more than one year prior to

filing this action, by reason of the abandonment and desertion of defendant for

no cause on the part of plaintiff, and that by reason of the acts of the

defendant aforesaid, plaintiff is entitled to a divorce from said defendant.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by this Court that the

plaintiff M.B. Pickering be, and he is hereby divorced from said defendant,

Lusanna Pickering, and the bonds of matrimony heretofore existing is hereby

dissolved and both parties are released from the same.

IT IS FURTHER ORDERED that this decree do not become absolute and

effective until after six (6) months from the date hereof.

OBITUARY: Nora Lee Pickering was born February 21, 1872, was 74 years, 5

months, and 29 days old, and died August 19th 1946. One son, Melton Ezell,

deceased, which leaves one daughter, Effie Granger; nine grandchildren,

seventeen greatgrand children and a host of friends who mourns, her death. She

prepared a hope in christ many years ago and remained faithful until death.

county jail here facing charges of larceny of domestic animals in connection

with hog theft.

Deputy Robert Ives made the arrests after searching two houses in which he

discovered meat that had been skinned. He said he found the hog hides secluded

in the woods.

and stopped to ask for directions. She was found on the road by her father and the lady's husband

Dodd City's Nees gets TSWA All-State honor

from staff and wire reports

BRYAN - Thorndale pitcher Eric Hinistroza, who led the Bulldogs to a state baseball

championship, was named the Class A Player of the Year by the Texas Sports Writers

Association.

Hinistroza, a junior, was 14-0 with an 0.35 earned run average. He had two no-hitters and

seven shutouts. He struck out 155 batters in 80 innings. At the plate, Hinistroza hit .411 with

five home runs and 32 runs

batted in for the 24-2 Bulldogs.

Among area players, Dodd City third baseman Timmy Nees was selected secondteam

All-State by the TSWA. The Dodd City junior batted .522 for the Hornets, who advanced to

the Region 11-2A semifinals. Nees also hit one home run and drove in 23 runs for the

Hornets, who finished 18-8.

Nees especially was dangerous during District 12-A play, batting .667 - that despite

moving from catcher to third base.

"He did a superb job hitting," said Dodd City coach Judd Marshall. "We went through the

change with Timmy moving from catcher to third base, and everyone had trouble at first. After

he made the change,

he did a good job.

"He hit the ball so well. He's one that when practice was over, he stayed afterwards to hit.

He was taking soft toss, and I wore my arm out pitching to him."

Hinistroza was a unanimous selection along with Iola outfielder Jason Lovell, who hit .571

with 19 RBL 28 runs scored and 29 stolen bases.

The other pitchers were Justin McCabe of state runner-up Spurger and Brian Hinze of

Burton. McCabe was 12-0 and Hinze 17-2.

Joining Lovell in the outfield are Crawford's Shane Walker (.508, nine assists) and

Thorndale's Joel Simank (.485, 34 runs scored, 44 steals).

Other first-team selections were: Bremond catcher Dustin Dugan, Thorndale first baseman

Nick Merz, Iola second baseman Cody Evans, Gorman third baseman Ronald Majors, Zuvalla

shortstop Greg Runnels and Colmesneil designated hitter Joey Brown.
