In the name of God Amen.  I Henry Newton of the State of Tennessee Robertson County being weak of body but of sound memory and mind calling to mind the mortality of the body and that it is appointed for all flesh once to die do now make this my last will and testament.

1st I give my soul to God who gave it to me and my body I recommend my body to the earth to be buried in a decent Christian burial at the direction of my wife Nancy Newton and E.S. Wood (or E.L.) nothing doubting but what I shall receive the same again at the general resurrection day by the mighty power of God and as touching my worldly estate herewith it hat pleased God to bless me with in this present life I give and bequeath/devise in the following manner and form viz.

Item 2nd I will to my wife Nancy Newton all my effects real and personal together with all my demands and dues freely to be disposed? by her the said Nancy Newton during lifetime or widowhood and she the Nancy Newton shall no power to sell or transfer property for the benefit of one child more than another except those that have yet to be raised, except the following donations hereafter mentioned.

Item 3rd to my daughter Sarah I will any two year old bay filly one bed stead furniture one trunk and candle stand.

Item 4th I will to my son Robert my last Spring colt also to my son William one bed and furniture also son Henry and Robert one bed and furniture at their mothers death or sooner if to be spared from the use of the house.

Item 5th to my son John I will the colt now carrying by the bay mare with a bed and furniture.

Item 6th To my son Edward I will the colt now carrying by the black mare with a bed and furniture to be poposed? By them at age of twenty one

Item 7th To my daughter Caroline I will the best nag on the farm at my wifes death not otherwise disposed of like wise one bed and furniture.

Item 8th I will and desire that if the above legatees should not bet the above mentioned articles before or at my wifes death they shall receive the sum of forty dollars for each horse and the price of a common bed oversame above the rest of my children.

Item 9th At my wifes death or marriage I will that all my estate real and personal shall be sold and equally divided amongst all my children viz, Sarah Newton, Isaac H. Newton, Anderson Newton, William Newton, Henry Newton, Robert Newton, John Newton, Edward Newton and Caroline Newton. In Testimony whereof I have hereunto set my hand and affixed my seal this 6th day of October in the year of our Lord one thousand and eight hundred and thirty four Sealed and Signed in the presence of us the subscribing witnesses viz    Henry Newton

State of Grainger, Robertson County Court November Term 1884

The foregoing was presented in Court and Benjamin S.Church/Chance? And William Riggs subscribing witnesses (unk word) who being first sworn depose and say that they witnessed the same at the request that the said Henry Newton acknowledged the same to be his last will and testament and that he was in his proper mind and thought the court allowed the same to be (unknown word) Test.  W.
