James Overstreet (M)

James Overstreet was born in Virginia and died in Jessamine Co., Ky.  He and Nancy Davis/Lewis were married July 25, 1783 in Virginia.

 

Anyone that has researched James Overstreet has no doubt seen copies of the papers from the James Overstreet Bible. Many copies have been made and circulated for most of this century. The Bible was in existence until early in the twentieth century. At that time it was destroyed in a home fire.

 

The records continued to circulate and that perpetuated the idea that James had three wives and twenty-one children. He did indeed have three wives, but only nineteen children. For some reason his first child with wife Nancy was left out of the Bible and that child's orphaned children were listed. Son Richard was born 1784 and died 1811. He was the father of Susan, Emeline and John Hartley.

 

When Lillian Parrish Overstreet was doing research for her book "Kentuckians of Yore and Kinsmen Galore" she had the good fortune of finding a petition in Jessamine County, Kentucky that sets the records straight.

 

CIRCUIT COURT CLERK'S OFFICE, JESSAMINE COUNTY, KY. FROM DECREE BOX 262 ---APRIL 20, 1818

 

To the Honorable the Judge of the Jessamine Circuit Clerk in the State of Kentucky your petitioner Nancy Overstreet respectfully represents that James Overstreet deceased her late husband died seized of a tract of land of about three hundred acres lying and being in the Circuit aforesaid which is improved and was his home plantation--Also of two hundred acres of unimproved land lying and being in the Adair Circuit Court and State aforesaid and adjoining the town of Columbia purchased by the said James Overstreet of John P. Anderson, that the said James Overstreet departed this life intestate and that the said two tracts of land passed from him by descent to Thomas Overstreet, Henry Overstreet, Elizabeth Jones wife of Richard Jones, Jane Harris wife of William Harris, Sally Harris wife of Benjamin Harris, John Overstreet, Gabriel Overstreet, Polly Wilson wife of Robert Wilson, Hartly Overstreet and Emeline Overstreet children and heirs of Richard Overstreet deceased who was a son of the said James Overstreet--William Overstreet, Polly Overstreet, Rice Overstreet and Elizabeth Overstreet children and heirs of James Overstreet deceased who was the son of the said James Overstreet deceased, Milly Felps wife of Smith Felps, Nancy Phillips wife of Thomas Phillips, Robert Overstreet, William Overstreet, Susanna Davis wife of Fielding Davis, and George Overstreet and Mitchell Overstreet.

 

Your petitioner further represents to your Honor that the said Hartly Overstreet and Emeline Overstreet children and heirs of Richard Overstreet deceased are infants under the age of twenty-one years--that the said William Overstreet, Polly Overstreet, Rice Overstreet, and Elizabeth Overstreet the children and heirs of James Overstreet deceased are infants under the age of twenty-one years and to whom your petitioner is guardian by appointment of the County Court of Jessamine County. The petitioner further states that she deems it for the interest of all the heirs of the said James Overstreet deceased and particularly for the interest of her said wards George Overstreet and Mitchell Overstreet who reside with the petitioner in the said Jessamine Circuit in her opinion that a sale of the said tract of land adjoining the town of Columbia aforesaid should make agreeably to the terms and provisions of the Act of the General Assembly of Kentucky passed and approved February 3, 1813 entitled "An act vesting jurisdiction in the Circuit Courts to authorize the sale of the real estate of infants in certain cases"--and that such sale will rebound to the advantage of the said George Overstreet and Mitchell Overstreet her wards.

 

Your petitioner further states that the said James Overstreet deceased her late husband had three wives--that the said Thomas Overstreet, Henry Overstreet, Elizabeth Jones, Jane Harris and Sally Harris are the children of the first marriage as she is informed believes and admits--that the said John Overstreet, Gabriel Overstreet, Polly Wilson and Samuel Overstreet and the said James Overstreet father of the said Will Overstreet, Polly Overstreet, Rice Overstreet, and Lizabeth Overstreet the children of the second marriage as she if informed believes and admits--And that the said Richard Overstreet the father of the said Hartly Overstreet and Emeline Overstreet, was and that the said Milly Felps, Nancy Phillips, Robert Overstreet, William Overstreet, Susanna Davis, George Overstreet and Mitchell Overstreet are the children of the said third marriage by your petitioner the third wife and last wife of the said James Overstreet deceased.

 

Your petitioner further states that the said Thomas Overstreet, Henry Overstreet, William Harris and Jane his wife, Hartly Overstreet, Emeline Overstreet, William Overstreet, Polly Overstreet, Rice Overstreet and Lizbeth Overstreet the last four children of James Overstreet, Robert Overstreet, George Overstreet and Mitchell Overstreet reside in the Circuit of Jessamine--That the said Gabriel Overstreet, Robert Wilson and Polly his wife, Samuel Overstreet and Smith Felps and Milly his wife reside in the County of Jefferson in this state as you petitioner is informed and believes--That the said John Overstreet and William Overstreet reside in Shelby County in this state as your petitioner is informed and believes--that the said Thomas Phillips and Nancy his wife reside in Montgomery County in this state as your petitioner is informed and believes--That the said Fielding Davis and Susanna his wife reside in Woodford County in this state as she is informed and believes--and that the said Richard Jones and Elizabeth his wife, and Benjamin Harris and Sally his wife reside in Louisa County in the State of Virginia as she is informed and believes.

 

Your petitioner further states that as the widow of the said James Overstreet dec. she hereby relinquishes releases and abandons all claim to dower in the said two hundred acres of land she having received an equivalent therefore in the tract of land and plantation in Jessamine County aforesaid--That William Overstreet was appointed by the county clerk of Jessamine and is guardian of Hartly Overstreet and Emeline Overstreet--That James Conner was appointed by the county court of Jessamine and is guardian to William, Polly and Rice Overstreet--that William Murrain was appointed and is guardian to Lizabeth Overstreet by the said county court of Jessamine--and that your petitioner is informed and believes that said 200 acres of land cannot be laid off and divided between the parties without loss and disadvantage and that all the parties desire of the sale aforesaid as your petitioner believes--Wherefore your petitioner prays a summons against such of the said co-heirs as are lawful age and the guardians of such as are under the age of 21 years calling upon them respectively to appear before this Hon. Court on the first day of their next term either of signify their assent or disapprobation of the joint sale of the whole of the said 200 acres of land for the mutual and equal interest of all the said co-heirs for money, upon such reasonable credit as the said Court may direct and your petitioner will every pray.

Mother: Nancy (McCarley) Overstreet (1804 - 1868)

 

Richard G. Overstreet was born in Jessamine Co., Ky.   He was a prosperous merchant, owning a men’s clothing store on South Main Street in Spencer, Indiana (Owen County).

 

His second wife, Elizabeth Jane Rawlings, was the daughter of Daniel and Rebecca Rawlings, and they lived near what is now Bloomington, Indiana.  Born in 1819, it is rumored that Elizabeth Jane was the first white child to be born in the Bloomington area.  Daniel and Rebecca had come from Virginia through Kentucky to Indiana as pioneers, and Elizabeth Jane became a teacher in a girls’ seminary in Spencer, Indiana.  The seminary location would later be the location of the Barton house, across the railroad from the Overstreet home (1865).  Elizabeth Jane is buried in Riverside Cemetery, Spencer, Indiana.

Anna Elizabeth Overstreet (F)

(February 7, 1864 – February 27, 1930)

 

Pedigree

Father: Richard G. Overstreet (December 18, 1827 – February 8, 1881)

Mother: Elizabeth Jane Rawlings (August 4, 1819 – September 25, 1901)

 

Anna was born in Spencer, Indiana in the upstairs apartment of the Overstreet building on South Main Street, a men’s clothing store owned by her father.  (This building would later be known as Bayh Hardware.)  When she was a year old, the family moved to a residential property on East Franklin St., which subsequently had been known for years as the Overstreet home.   As a young girl, she joined the Methodist Church and remained a loyal and active member until her death.  She was especially active in the work of the Foreign Missionary Society, of which she was a charter member, and was one of the Naomi Class of the Sunday School.  Anna graduated from Spencer High School in 1881, and attended one year at DePauw University, where she was a member of the Kappa Alpha Theta sorority.  The death of her father made it necessary to drop out of college and return home to stay with her mother who had a broken hip.  At her father’s death, her brother William Irwin took the Overstreet building when the estate was settled, giving Anna the Overstreet home and land.  Anna was a woman of fine character, a splendid, wholehearted neighbor and a mother whose greatest delight was in her children and grandchildren.  Anna Elizabeth died in St. Vincent’s Hospital, Indianapolis, Indiana at age 66.
