This is my last attempt to regain the place which I deserve to be in, like everybody else. It is my last cry to the public to know about a crime which was perpetrated by psychiatrists, aided and abetted by the law establishment. For the past thirty-five years I have been attempting unsuccessfully to have a public inquiry into my situation which, I am certain, would reveal a crime unheard-of in Canada, if not in the world.
Briefly, in 1971, I was illegally arrested and incarcerated in mental hospitals for about six months, without any prior medical examination whatsoever, and without any proof that I was mentally ill.
While I was living in Hamilton, Ontario, an unscrupulous psychiatrist, named Jacques Grenier from Quebec City, had libelled me as a dangerous and mentally sick man. On my arrival in Quebec City, to visit my children who were living there with their other parent, I was arrested without a warrant. I was incarcerated without a judicial decision: tortured and brainwashed into believing that I was mentally sick and dangerous.
It was obvious that Dr Grenier committed a terrible faux pas at the outset of the story, since I was never seen by him. Thus, his diagnosis was contradicted by the psychiatrist on my admission to the hospital. Moreover, it is written in the records, a few days after my admission, that a reliable psychiatrist, who was a friend of mine, was astonished to hear that I was interned. He reproached the doctor in charge, Dr. Dorion, and said that the incident was like a "tempest in a teapot".
Instead of admitting their error and to excuse themselves, the psychiatrists involved resorted to cover up for each other with criminal acts. I asked for help from the Ombudsman and Legal Aid, but, unfortunately, they gave the green light to the perpetrators of the crime.
According to the evidence, during the middle part of my internment I was supposed to be "free definitely", approved by the Board of Review (Comité de révision). In fact, I was transferred for "disciplinary treatment" in another hospital. Finally I was discharged with a diagnosis of "situational depression" and "directed", i.e. expelled from the Province of Quebec to Hamilton in Ontario. Though I was treated as a "very serious patient" in hospital, I was discharged without any medications and with no follow-up of my "sickness"!
It is not enough to say that I was tortured and treated worse than any animal by these psychiatrists with no human compassion whatsoever. My fundamental human rights were violated in a most barbaric way. The heretics (defamatus) during the Inquisition were treated better than I was. My life was literally devastated.
My request for help after my release by the Protector of Citizens (Ombudsman) of Quebec was rejected out of hand, although it was obvious that my internment was illegal and more than inhuman.
My case was heard in court. However, the trial judge's judgment is as preposterous as the psychiatrists and their medical records. Obviously, the judge's intention was to cover up for the criminal psychiatrists and protect the law officials who had refused my cry for help. He ignored the medical records that were written by the very same psychiatrists involved. He "supported" his judgment with the "hors-dossier" (out of the records) testimony that was filled with a pack of lies. He did not even hesitate to impute me with a "partial admission of préjorative (sic) violence", which -- "préjorative" or any -- never occurred and was never proved.
Prof. William Schabas wrote in the preface of my book that in his "view there were some serious errors in the reasons given by the trial judge". I dare to add to Mr. Schabas' opinion that no reasonable judge would take seriously the Court testimonies when compared with the original medical records written by the very same psychiatrists! The same will apply for the judgments of the Court of Appeal and the Supreme Court of Canada.
Art. 1234 of the Civil Code of the Province of Quebec explicitly relates:
Testimony cannot in any case, be received to contradict or vary the terms of a valid written instrument.
In other words, written medical records -- the best or primary proof -- cannot be substituted with oral testimonies.
Prof. L. Ducharme also wrote, "This prohibition (to substitute written document with oral testimony) is not new, it exists since the Ordonnance de Moulin of 1566." It could not be otherwise; common sense dictates it!
Besides, the psychiatrists involved realised themselves that the originally written records were forceful evidence against themselves. Thus, they tried to falsify the records. But again, astoundingly, because the doctors involved had "doctored" my records in such an incredibly asinine way, even a casual reader could see that they had been in the hands of forgers. An expert confirmed the forgeries. The trial judge termed the medical records in his judgment an "accablante évidence" against the psychiatrists. Yet, the judge rejected my claim that the psychiatrists were fraudulent and incompetent.
Recently, when I requested the copies of the documents regarding the inquiry, which the Ombudsman had supposedly accomplished, I received a letter from the Office of the Protector of Citizens (Ombudsman) that the records had been "destroyed". Obviously, the destruction of the documents is a cover up of the original cover up of my internment.
Unfortunately for my "doctors" and for all the persons involved, including the Protector, however, I had succeeded in obtaining all the relevant medical and judicial documents upon my release from hospital many years ago. The records, therefore, speak for themselves.
These medical records, besides showing that falsifications had been made, also proved that those psychiatrists were mentally and intellectually defective.
It was proved during the trial that the medical and juridical authorities used audacious perjuries, forgeries and other fraudulent manoeuvres. I dare to state that the Canadian justice system totally failed in my case.
After so many years I stand by the same firm opinion: I was tortured and maliciously labelled as a mad and bad man without any reason whatsoever. All the people involved should at least be reprimanded. Today, with advanced techniques and science, it is easy to find out whether I was properly treated by the medical and judicial authorities.
According to the medical records I was a good father. I was taking good care of my children and they had adored (sic) me. When my family was in Yugoslavia, I was able to amply provide for their needs because as a physician in the former Republic of Yugoslavia, I had earned more than a specialist when my overtime was added to my basic pay.
I am now over 84 years old. For over 35 years I am living through harrowing suffering and humiliation. I have had numerous discussions about my case with my friends and acquaintances. Many of them were of the opinion that I was very patient and restrained, since I have not tried to commit suicide or homicide. No, I am not the suicidal nor the criminal type to harm anybody.
Nevertheless, since I had been discriminated and tyrannised in the most brutal way possible, during the last 25 years I have used all the legal means available to become a respected person with my human rights protected. But my efforts to rehabilitate myself have fallen on the deaf ears of the authorities responsible. Therefore, I do not have any other way but to use this last resort to fight against tyranny and oppression, as recommended in the Universal Declaration of Human Rights:
Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law.
I believe that a public inquiry by the media or by an appropriate impartial official, would bring to light the wrong deeds done by all the persons whom I charge as being responsible for my fate.
My sons know that whatever I am writing is the truth. They could render instant justice. They could derive a monetary and moral benefit from my case. Besides, I am at the end of my life. Their father's label as "mentally sick" would follow them all their life.
Furthermore, if my former lawyer, Professor William Schabas, and his wife Penelope Soteriou, were to resume charge of my case as my lawyers, I will definitely succeed, because they are familiar with my case and Prof. Schabas is a well-known scholar of human rights law.
In conclusion, because of the numerous miscarriages of justice that have occurred in my case, surely it is warranted that I insist upon a thorough review of my case. Indeed, I shall be grateful for any assistance and collaboration from all concerned citizens.
I am a honest and reasonable man. Even my psychiatrists had complimented that I was intelligent (Il semble être très intelligent, I.Q.+-125). I place great value on my dignity. This press release is my last attempt to regain the place which I deserve and, afterwards, eventually to die honourably like anybody else. Nitsche, the famous German philosopher said, "If you do not live honourably, it is better to die honourably.
We know from history that, since psychiatry is recognized as "medical science", these psychiatrists have shamelessly misused and abused their own profession. Remember the scandal with the "Duplessis' Orphans", an accomplishment of a collaboration of Quebec psychiatrists and law executives.
As for "law science" we also know that, like a football, it could be played in a direction desirable for the players and referees. Remember the outrageous failures of our justice in the cases of innocent young men -- Donald Marshall, David Milgaard and Guy Paul Morin, just to mention a few. If we were to take into consideration a combination of these two "sciences", we could only imagine the destructive consequences of the "football game" on the lives of innocent people. My case, like those of the "Duplessis' Orphans", is precisely a result of the game of the players of that ilk: psychiatrists and jurists who are truly representatives of those two "science".
I have had a chance to discuss my case with some "learned friends". All of them were unanimous in their opinion that I was a victim of these unscrupulous psychiatrists. Nevertheless, they are extremely hesitant to condemn directly their own colleagues -- lawyers, judges, Ombudsman. They used to say that my case is "complex". It is only complex when we stray from the truth and facts.
The truth and facts are that I am a man, like everybody else, who has never been mentally sick and has not harmed anyone, at least not up to now. And the truth and facts are also in the written records of those who had destroyed my life.
For those readers who are curious about the "complexity" of my case, I recommend that they read my book, "Psychiatry and Justice on Trial", with a preface by William Schabas, Professor of Quebec University, and a draft-version in French which is not published yet "L'inquisition de nos jours". In the French version the medical records and the judgment by Honourable Judge Pierre Boudreault are transcribed verbatim. Both documents are on the Internet (www.globalserve.net\~rdelev). For financial and technical reasons, I could not completely scan the records and judgment. I have illustrated my writings with a few randomly chosen quotations, mostly written by the psychiatrists involved. Incidentally, I shall be pleased to send a copy of the original records and judgements, on request.
I have a strong desire to organize a conference during which time, I, with my poor French and English, intend to present my-self, the medical records, judgement, and by the same token the competence and moral and mental qualities of all involved "experts" in my case. Of course, all of them would be invited and would be welcome to take part in the discussion.
I would appreciate if anyone who is interested to attend the conference would give notice to the writer, eventually to be notified for the time and place of the conference. I believe it would be worthwhile to hear and see more "accablante evidence" against those unscrupulous psychiatrist and, by the same token, against the law authorities who are supposed to protect the people from the criminals.
