Dear Sir and Brother,
The undersigned members of Teamsters Local 726 are bringing these charges under the International Brotherhood of Teamsters Constitution Article XXII and Local 726 By-Laws Section 19 Meetings against President John Falzone and members of Local 726 Executive Board who were present. This includes Thomas P. Clair, Kenneth Brantley, Jack Hurley, Michael Marcatante and Anthony Fiore.
We charge Brother Falzone and all the above mentioned members of the Executive Board with blatantly violating the rights of the members of Local 726 to vote on motions which were properly made at our May 16, 2007 Local 726 Union Meeting.
Brother Vercillo requested to make a motion on the floor and was granted the floor by Brother Falzone. After hearing Brother Vercillo’s motion, Brother Falzone ignored Brother Vercillo’s motion and Brother Vince Tenuto who seconded the motion to have the Union Meetings not be suspended from June 2007 through October 2007. Brother Falzone refused to bring the motion to the floor for a vote. After making the motion Brother Vercillo was told he could not make the motion and that it was already a By-law. Brother Vercillo was also told to read the By-law book. Brother Vercillo asked Brother Falzone to read this part to the membership. Brother Falzone refused the request. Brother Falzone refused a motion properly made by Brother Vercillo to Brother Clair, the Chair, to overturn Brother Falzone’s ruling. Brother Falzone simply refused to even let Brother Clair, the Chair to answer.
After Brother Falzone had a motion to adjourn the meeting, a second was made and he refused to bring it to the floor for a vote. His reply was “he supersedes everything.”
We have tried repeatedly to contact Brother Clair and Brother Falzone by phone, fax and certified letter to find out if the meetings will be held or suspended from the months of June 2007 thru October 2007 without success. (See attached letter)
Brother Falzone violated the International Brotherhood of Teamsters Constitution Article XXII and Local 726 By Laws Section 19 MEETINGS (1).
This letter is to inform you that we are requesting a hearing on these charges by the Joint Council 25. According to the International Brotherhood of Teamsters Constitution page 136 Article XIX, Section 1(A), paragraph 3. This article states:
“Charges by, against, or involving a majority of the members of a local Union Executive Board shall be filed with the Secretary-Treasurer of the Joint Council for trial by the Joint Council Executive Board. Where there is no charter Joint Council, refers this article XIX relating to trials and appeals by or before the Joint Council shall apply pursuant to Article XV to the appropriate existing State or Multi-State Conferences“.

Dear Sir and Brother:
At the last Union meeting on May 16, 2007, Brother Vercillo motioned that the meetings not be cancelled through the months of June 2007 through October 2007. He was told by Brother Falzone that he could not make this motion. He then asked Brother Falzone are the meetings still going to be held through the months of June 2007 through October 2007 or not. His reply was “Read your By Law book”. We feel he should have just answered the question. If you read the By Law book in Section 19 MEETINGS (1), it clearly states: Membership meetings may be suspended between June and October by action of the membership at a meeting after reasonable notice of the intentions to vote upon such a question.
We are requesting a written statement informing us if there will be meetings during these months so that we can inform the rest of the membership.
