4) In consideration for the above services to be rendered during the term of the AGREEMENT, EMPLOYER shall pay ARTIST as follows: $_________ guaranteed vs. 100% of gross gate receipts, whichever shall be the greater sum.
5) EMPLOYER warrants that there are no other contracts that would infringe upon the rights and services herein granted.

7) THEREFORE, in consideration of paragraph 6, whereby the ARTIST reserves services to the EMPLOYER for the time specified, EMPLOYER agrees to provide ARTIST the compensation specified in paragraph 4, in the event that performances are cancelled due to any reason other than the ARTIST.
8) ARTIST reserves all rights concerning the material that they perform.
9) EMPLOYER is liable for damage to the ARTIST'S stage equipment resulting from a patron-induced infraction during the time period specified in paragraph 2.
10) ARTIST hereby agrees to appear punctually at the hour appointed for all performances.
11) ARTIST shall receive 100% of gross merchandise sales receipts.
12) This contract contains all of the agreements and conditions made by the parties hereto with respect to the subject matter hereof and may not be modified orally or in any manner other than an agreement in writing signed by the parties hereto or their respective legal representatives.
13) Each party signing below warrants that he or she is a legal representative
of the ARTIST or the EMPLOYER, with full authority to enter
this AGREEMENT.
