Point System Review
The Motor Vehicle Act requires that points be assigned to a Driver's Record as the result of convictions for certain offences under the Act. Points remain on the driver's record for two (2) years** from the date of conviction, however, the conviction remains of the record for five (5)years.
**(except when the holder of a driver's license or the privalege of obtaining a license is sooner suspended)
WHEN THE HOLDER OF A LEARNER'S LICENSE
(a) has 2 or 3 points assigned to their record, an advisory letter may be sent.
(b) has 4 or more points assigned to their record, their driving privaleges shall be suspended for a period of six months.
NEWLY LICENSED DRIVER (DEFINED)
A person who qualified for a driver's license, having less than two (2) years experience as a licensed driver, excluding experience while holding a Class 7 or 8 Driver's License, has the status of a Newly Licensed Driver. A revocation (Section 278) or Suspension (Section 100A, 100B, 205, 227, 279, 279A, 282, or 283) during the Newly Licensed period, will require the person to complete a minimum two (2) year period as a Newly Licensed Driver from the date of restoration.
WHEN A NEWLY LICENSED DRIVER
(a) has 3 points assigned to their record, they may be sent a warning letter.
(b) has 4 or 5 points assigned to their record, they are required to appear for an interview with a Driver Enhancement Officer.
(c) has 10 or more points assigned to their record, their privaleges shall be suspended for a period of six (6) months.
WHEN ANY OTHER DRIVER
(a) has 4 or 5 points assigned to their record, they may be sent a warning letter.
(b) has 6 to 9 points, a re-exam may be required or an advisory letter sent; based upon the activity appearing on the driver record.
(c) has 10 or more points assigned to their ercord, their driving privaleges shall be suspended for a period of six (6) months.
PROBATIONARY DRIVER (DEFINED)
Following a period of suspension, resulting from an accumulation of points, the driver will have a status of Probationary License for a period of one year. If, during this term, three or more points are assigned against the driver's record, their driving privaleges shall be suspended for a period of six (6) months.
DEFENSIVE DRIVING COURSE
The Registrar may deduct up to four points from the record of a person upon being satisfied that such a person has successfully completed a self-improvement defensive driving course within the preceeding year. (This applies to points first entered and still existing on the person's record at teh tiome when the Registrar acts.) Points cannot be deducted from a Class 7 license, Class 8 or a Newly Licensed Driver.
OUT OF PROVINCE DRIVER
The Registrar is authorized to suspend or revoke the right of any non-resident to operate a motor vehicle in Nova Scotia for any cause for which the license of a resident Driver may be suspended or revoked.
OUT OF PROVINCE CONVICTIONS
When the holder of a Nova Scotia driver's license/resident is convicted of an offence in another Canadian Province, the Registrar shall enter the conviction and the points associated with the table described in the Act or Regs.
