DECLARATION OF PETER ROMANOWSKY
I, Peter Romanowsky, do hereby declare and testify that if I were to be called as a witness in open court and testify under oath, that I would competently do so as follows:
1. I was in Marin County Court House, Judge Verna Adams Court Room, during the court trial of People of the State of California –v- Carol Mardeusz, who was represented by lawyer, Patricia Barry.
2. During the weeks of July 7, 2000 through July 24, 2000, I was present at three trial days and one day for an associated hearing.
3. On all four occasions I witnessed lawyer Patricia Barry being abused by Judge Verna A. Adams. On one such occasion specifically I saw Judge Verna A. Adams continuously pout, puff her cheeks, make faces and turn red with anger as Patricia Barry flawlessly executed her duty as officer of the court in the representation and defense of Carol Mardeusz.
4. On another occasion Judge Verna A. Adams began twitching as Carol Mardeusz took the witness stand to testify on her own behalf. Verna Adams began making spastic motions and head cocking, notioning to the jury to disbelieve Carol Mardeusz and her lawyer Patricia Barry. Her obvious body language and facial expressions were designed to show contempt for Carol Mardeusz and her lawyer Patricia Barry in full view of the jury. It was extremely disconcerting and damaging to the Mardeusz’ defense and Patricia Barry’s attempts to defend her client.
5. On all four occasions, Verna A. Adams constantly interrupted the defense proceedings to fragment the testimony of all the defendant’s witnesses and to cut off the flow of information to the jury that would have found Carol Mardeusz innocent of the charges. It was the worse hack job that I’ve ever seen a Judge do to a lawyer, Patricia Barry, who was extremely cohesive and professional in her conduct. In spite of the constant interruptions, face making and body making gestures with her head jerking from Verna Adams, which I saw was committed only to extremely prejudiced the jury against Patricia Barry’s defense of the accused Carol Mardeusz. In my professional opinion as a Minister and former full time Pastor, my first impression of Verna Adams was that she was directing the jury to find Carol Mardeusz guilty and was continuously downgrading Patricia Barry’s professional conduct.
6. Judge Verna Adams deliberately and repeatedly tried to upset, agitate, and penalize lawyer Patricia Barry for doing her job well in the defense of Carol Mardeusz.
7. Patricia Barry tried to defend herself against accusations from Judge Verna Adams that she was out of line in her attempts to defend Carol Mardeusz, but Judge Verna Adams harassed and vexed Patricia Barry even more. I believe that at no time Patricia Barry was out of line in her appeal to Judge Verna Adams for fairness in the defense of Mardeusz, but Judge Verna Adams continued to abuse Patricia Barry no matter what.
I declare under penalty of perjury that the foregoing is true and correct to the best of my knowledge and belief. This declaration was signed in the County of Marin, State of California, executed on July 25, 2000.
