The civil war was fought becasue the federal goverment was becoming more powerful than the state goverments. The north was trying to push the federal goverment the south was trying to push state rights. To sum it up the federal goverment won and thus becoming this overwhelming power. You see our right to bare arms and right to milita was created as a fail safe for society to over throw the goverment in case of it becoming too powerful. People pushing gun control are following in Adolf Hitlers Footsteps by taking the guns away from society leaving the only people with guns being the goverment who then have all the power. America was founded to give power to the people not to a leader or a system. We failed our duties as americans to over throw the revolving power that gains momentum every year to the point where it will just plain strip us of all our rights and revert to communism.
Now lets get on the subject of the 4th amendment no unreasonable search or seizure. This is a federal law wich by meaning over throws any state law. There is a state law called "implied consent" that deals with drivers. Where if you drive a car the police have the right to search your car without a warrent. This law holds no grounds in court IF you know your rights. Basicly if your car gets searched and they find anything that evidence was obtained unconstitutionally and will hold no ground and the case can be taken to a federal court level in wich case you will be appealed if and ONLY if you know your rights.
Now to what inspired me to write this blip is an segment i saw on CBS news. They managed to shut down a school's drug dog policy becasue it was unconstitutional. And this goes for any school even though schools still suport the policy. They showed a dog set of 72 hits but 71 of them where nothing. This infuriated parents and brought this to school board. The school board said they had the right to make it open policy to search the students and there posessions with drug dogs so the parents took it to federal court under unreasonable search and seizure and won. It is unconstitiional for the school to search the studens case A: They do NOT have reason for "Random" drug dog checks. and B: its without student and parents consent. Another case where federal goverment overpowers other goverments wich actually is a big break through.
On a diffrent note of the law just something to keep your minds sharp. SWAT team members wear ski masks over there face. do you know why? it doesnt protect there face. Basicly alot of the things swat team members do is illegal. When they bust into your house and start breaking up shit even with a warent they arnt allowed to destroy your property. When they wear a mask if a mistake happends and you get killed no one will get prosecuted casue they would have to fall by ranks casue there identies are hidden and no brand in any service of law enforcement or military will fall by ranks.
I'll just say this if a man breaks into your house with a gun and a mask on and you kill him for all you know he is a robber. There is a chance though you will be killed if you kill one of them but they cant legally kill you if you are unarmed. So if some one pays you a visit in a mask with a gun and you kill them you throw your gun down and get on your knees with your hands behind your head and do not talk chances are you might be only be convicted with manslaughter wich is alot better than pre-empted murder, and death of an officer. If they really want to screw you can can charge you for destruction of goverment property.
I was once reading a turkish newspaper article my dad kept where a police officer was doing a drug dog search on a very important radar base and he found someting in the head of the base's office. There was only mear tylenol and the officer got introuble. Then that dog again found nothing more than cough drops in a bunk and the officer got introuble again so he shot his dog. They charged that officer with killing an officer of the law and destruction of goverment property.
