Terminator Star Says He Doesn't Own a Porsche
Los Angeles - Arnold Schwarzenegger's face is instantly recognizable across most of the world. As the undisputed champion of action movies, he commands one of Hollywood's highest salaries. With such a high recognition factor, his likeness has substantial commercial value. So when his face appeared on the cover of an auto magazine published and distributed by numerous subsidiaries of Gemballa GmbH, promoting Gemballa's Porsches without his permission, Schwarzenegger filed a complaint against Gemballa. The suit alleged that the November 1995 issue of Sport Auto, an association of Gemballa, displayed on the front cover a picture of a smiling Schwarzenegger standing next to a Gemballa Porsche and giving a "thumbs up". The cover stated that the car was built for Schwarzenegger, and referred to him driving or admiring Gemballa Porsches numerous times in the included article. Schwarzenegger alleged that he does not own, has not driven, and has never been photographed near a Gemballa Porsche, and at no time authorized his likeness to be used in reference to the car. Schwarzenegger's suit listed numerous causes of action related to unfair and fraudulent business practices, and also sought an injunction preventing Gemballa from any further use of his likeness. Schwarzenegger requested an award of $5 million in compensatory damages, additional punitive and exemplary damages, and an award of the gross revenues derived by Gemballa by the use of his likeness. |
