Moore, 5th Great-grandson, from a copy of the original will) I, Jacob Martin, of the County of Perry in the State of Ohio, do make and publish this my last will and testament in manner and form following, that is to say: First, it is my will that my funeral expenses and all my just debts be fully paid. Secondly, I will that my real estate amounting to 89 acres of land be the same more or less be sold to the highest bidder at public sale and the money arising from such sale I will to be equally divided amongst my lawful heirs. Thirdly, I will and bequeath to my beloved son, George, all that is due me on three notes amounting to two hundred and twenty seven dollars and 50 cents principled with al interest thereon, as compensation for taking care of me. Fourthly, I will that all my personal property be sold and all moneys arising therefrom after the payment of any just debts be equally divided amongst my just heirs. And lastly, I hereby constitute and appoint my son, George Martin, to be the Executor for this my last will and testament revoking and annulling all former wills by me made and ratifying and conforming this and no other to be my last will and testament. F. Hickman the Judge of said Court, the following proceedings were held in reference to the Probate of the last will and testament of George Martin, late of said county, deceased, as will appear by journal No. 3 of said court, page 15, to wit: July 25, 1862. George Martin, dec'd, This day the last will and testament of George Martin, late of Perry County, Ohio, deceased was produced in open Court and thereupon came Henry Kelly and Samuel Lyle the subscribing witnesses to said will who testified on oath to the due execution thereof which testimony was reduced to writing by said witnesses, subscribed and filed with said will, and it appearing from said testimony, that said will was duly executed and attested and that said George Martin at the time of executing the same was of full age, of sound mind and memory and not under any restraint, it is therefore ordered by the Court that said will and testimony be recorded, whereupon John C. First: I will and bequeath to Elizabeth Thomas, wife of Mathias Thomas, a certain house and lot No. 70 in the town of Putnam, and more particularly known, as the house in which she now resides, with all the appurtenances during her natural life, or so long as she may wish to occupy the same, in her own person, but not to be disposed of in any manner and when she is deceased, then the same is to descend back into my estate, and 2. Secondly: I wish all my just debts and funeral expenses all legally paid. 3. Thirdly: I bequeath to my wife Hester Martin, all the entire balance of my estate during her natural life, for her support, except the house and lot above mentioned. I further will that immediately after my decease, that all my personal property, of every kind, be brought to sale, by my executor, without any appraisement and to be sold at public sale, legally advertised, the effects arising therefrom to be used, in payment of all legal claims as the [?] provides, and also all money due, to be collected as well as all on hand, to be collected and used, in the same manner. Be it understood, that the portable saw mill is excepted, and my share of the same is to remain as it now is, and to be used in company with the other shares, in said mill, and the profits arising therefrom to be used and considered belonging to my estate and appropriated for the benefit of my beloved wife if needed, but if in case the other shares of said mill is sold, my interest therein to be sold, also I furthermore except from sale, for the use of my beloved wife two beds, and all that pertains to the same, to be selected by suitable persons and to remain for her comfort wherever she may reside, and not to be sold during her natural life. And I furthermore direct by this instrument that after my decease that all my real estate be judiciously rented, and the avails arising therefrom to be used for the entire benefit of my beloved wife Hester Martin, and if she should need additional funds for her support, then and in that case, certain portion of my real estate be sold, after legally advertising to the highest bidder, by receiving one third cash the balance in two equal annual payments, with interest on the deferred payments and secured my mortgage, and should it be necessary to sell the real for the above purpose, then and in that case I authorize my Executor to sell my real estate at Deavertown, and if more should still be needed for that purpose, or any other, then I direct that the rest of my real estate known as the Franklin property, be next disposed of in the same way, then if this should still be insufficient, then the [?] balance to be disposed of in the same way, and for the same purpose. And I now desire that my beloved wife make her home with her sister Elizabeth Thomas, and that a reasonable amount be paid to said Elizabeth Thomas, in cash for the purpose of paying for my beloved wife's boarding and clothing, and medical bills, but not for waiting on her, as I design the use of the above mentioned house and lot as a compensation for that purpose, and this to be the arrangement, so long as the two sisters may feel agreed thereunto, and when she, my wife, chooses to remove for her comfort to some other locality, then this to be done at the expense of my estate. And now in conclusion, I will that at the death of my beloved wife, all my estate, or balance unexpended be equally divided among my sons and daughters, or their heirs, share and share alike, after having been disposed of as above stated. N.B. If my daughter, Sarah Williams, would prefer having her portion that may be due to her, set off in real estate, then and in that case, I appoint Henry Kelly, Wm. D. Laird, and James Ardrey to be called on, and after having been sworn moved to make an estimate of said balance due her, and make a set off in lands to said Sarah Williams, immediately adjoining the lot that she now owns, and occupies, and that the same course be pursued, with reference to my daughter Eliza Dollings, in order that each of them have their portions adjoining to their present residence, if they or either of them should desire but not otherwise, and further I declare that all monies on hand, or may come into the hands of my Executor from time to time be properly used as herein set forth, and should any remain uncalled for over the sum of one hundred dollars, then and in that case, the same to be kept on interest and the payment thereof be will secured. And finally, it is my desire that my son John C. Martin, act as my Executor, and to see that it be faithfully and impartially acted out, and carried through, according to the time, intent, and meaning thereof, after having given bond, and security to the acceptance of the Court. And also I appoint my son George W. Martin, to act as Guardian for his mother, my beloved wife, to see that she be comfortably cared and provided for, and to receive money from time to time from Executor for that purpose, after having given bond and security to the acceptance of the Court. And now in concluding this my last will and testament, and having been very desirous of making ample arrangements for the continued support of my beloved wife, and in view of the fact that she is incompetent to make her election in the premises, I earnestly desire that the Honorable Court, would make said election for her, and see that the above arrangement be fully carried into effect. Notes for JOHN WILKINS: Text taken from: http://homepages.rootsweb.com/~tfisher/fphperrybiow.htm "WILKINS, JOHN, farmer; post office, Mount Perry; was born in 1816, in Frederick county, Virginia; son of James, Jr., and grandson of James, Sr., who was an English soldier; and in consequence of a severe wound in one of the battles of the Revolution, never again returned to his native country, but remained in Virginia, where he married a Highland Scotch wife, who became the mother of an only child, James Wilkins, Jr. This James was by tradition entitled to an estate in England, which was lost by the slackness of the laws then in force, and the infancy of the only heir in America, which heir perhaps was entirely unknown, on the false supposition that James, Sr., had died without heirs. The father of John Wilkins was a soldier in the War of 1812; the husband of Hannah Roberts, whom he married about the beginning of the present century; a superintendent of a large Virginia plantation, at a good salary for many years; the owner of a few slaves there, at the death of one of whom, John cried bitterly as having lost a kind nurse. In 1830 the Wilkins family came to Perry county, and a few years later to Muskingum county, where James, the father, died, at the age of eighty-five years. He was a man of remarkable physical endurance, and in his eightieth year, could plow, sow and reap. Mother Wilkins survived her husband only a few years. Her children were Nancy, the wife of Joseph, and the mother of Nathan Plank, who after the death of her husband became the wife of Joseph Snyder, and died as such in Hopewell township; Charles and Mary, of Lawrence county, Ohio; William, White Cottage, Ohio; Joseph, Lytlesburg, Ohio; Theodore, Lima, Ohio; Rev. Llewellyn, of the New Light belief; and two children, deceased, in Muskingum county. In 1839, John Wilkins was married to Mary, daughter of John Bowser. He soon settled where he now lives, section thirteen, Hopewell, and where some of the soil on his farm has been under cultivation for sixty consecutive years, and the last crop of corn measured over one hundred bushels to the acre. It thus supports its fertility by alluvial deposit, and by its natural strength. Their children are eight in number, all living, except Mary, deceased wife of Samuel Bowman, Arcola, Illinois; Leroy, farmer, post office same; James, John T., Eliza, wife of Samuel Bowman, and Abraham, post office, Mount Perry, Ohio; Ann Maria, wife of Daniel Siberds, and Emanuel, post office, North Manchester, Indiana. These sons and daughters are all comfortably situated, and some of them growing wealthy. Five of the sons weigh 1,160 pounds, the lightest of whom is nearly 200. The mother was a large, handsomely sized woman; the father has weighed 180 pounds; head twenty-two and one-fourth inches, health good, habits temperate, but not abstemious from stimulants. After the death of his wife in 1879, Mr. Wilkins was married to Mrs. Delilah Stine, in 1881, whose maiden name was Dollings; of Scotch and English parentage, and whose father was a native of Virginia, and whose mother was a native of Kentucky. By her first husband, John Creighton Stine, she had two sons, both married; one a teacher and the other a potter by occupation. She alleges that her grandfather, Slover, was a Tory in the Revolution, and that her father fought on the American side, in 1812.
