LAST WILL AND TESTAMENT OF PETER BARNETT
(Transcribed by Charles C. Moore, 5th Great-grandson, from a copy of the original will)

"In the name of GOD, Amen.  I, Peter Barnett, of the County of Perry and State of Ohio, calling to mind the certainty of death and the uncertainty of the time of it, and being weak in body but of strong mind and memory do make and ordain this my last will and testament in manner and form as follows, to wit:

After my just debts and funeral expenses are paid I will and bequeath to my beloved wife Mary Barnett all my personal estate of every kind and character during her natural life, and at her death to bequeath it to whomsoever she may see cause.  And moreover, I also bequeath to her all my real estate during her natural life and at her death said real estate is to be sold according to law and the money arising therefrom to be distributed in the following manner.  To my son John Barnett the sum of fifty dollars and my grand son Peter Barnett, son of John Barnett, the sum of fifty dollars.  To my son George Barnett one hundred dollars.  To my son Benjamin Barnett one hundred dollars.  To my son Jehu Barnett fifty dollars.  To my daughter Rachel Fickel two hundred dollars.  To Eliza Ann Watts, my daughter, two hundred dollars.  To my daughter Katharine Barnett two hundred dollars.  To my son Richard Barnett two hundred and fifty dollars.  To my grand son Edward Barnett, son of Richard Barnett, fifty dollars, and the sum of twenty-five dollars to be paid into the treasurer of the Methodist Episcopal Church, to be applied to the African Missionary Society.  And it is further my will that my sons, John Barnett, George Barnett, Benjamin Barnett, and Jehu Barnett, remain on the lots of land they now occupy during the lifetime of my beloved wife and to pay each of them to her as a rent the sum of twelve dollars annually.  But if not paid annually then they are to be charged the sum of eighteen dollars each, and the same to be deducted from their several portion of my estate.  And I further will and bequeath that at the death of my beloved wife the land to be legally sold as aforesaid, and after deducting and paying of the aforesaid sums of money as heretofore mentioned and all other legal charges paid off, then the unexpend(ed) balance is to be equally divided among my five sons and three daughters, to wit:  John Barnett, George Barnett, Rachel Fickel, Jehu Barnett, Benjamin Barnett, Eliza Ann Watts, Richard Barnett, and Katharine Barnett, share and share alike.  And further I declare that if my sons, John, George, Benjamin, and Jehu Barnett should remain on the lots they now occupy they are to take all reasonable care of the same, and not to sell or destroy any timber, coal, or such things off said lots, and the several rents to commence and be computed from the first day of January AD., 1848.  And of this my last will and testament I do hereby nominate, constitute, and appoint my son Richard Barnett as Executor, to see that the same be executed according to the true intent and meaning thereof, and moreover, to aid my beloved wife in collecting and receiving the rents and paying taxes.

In testimony whereof, I, Peter Barnett have hereunto set my hand and seal, this fourth day of February, one thousand eight hundred and forty eight."
