Supernumerary Assistant Collectors, Probationary Deputy Collectors and Probationary Tahasildars Departmental Examination Rules-1984.

 

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all existing Rules and Orders issued in this behalf and in force in the State or any part thereof, the Governor of Maharashtra is hereby pleased to make the following Rules, regulating the Departmental Examination for Supernumerary Assistant Collectors, Probationary Deputy Collectors and Probationary Tahasildars in the State of Maharashtra, namely:-

RULES

  1. These rules may be called the Supernumerary Assistant Collectors, Probationary Deputy Collectors and Probationary Tahasildars Departmental Examination Rules-1984.
  2. In these rules, unless the context requires otherwise:-
  1. "Commission" means the Maharashtra Public Service Commission;
  2. "Examination" means the examination prescribed under these Rules for the Supernumerary Assistant Collectors, Probationary Deputy Collectors and Probationary Tahasildars;
  3. "Government " means the Government of Maharashtra;
  4. "Probationary Deputy Collector" means a person appointed on probation by nomination to the post of Deputy Collector on the result of Competitive Examination held by the Commission;
  5. "Probationary Tahasildar" means a person appointed on probation by nomination to the post of Tahasildar on the result of Competitive Examination held by the Commission;
  6. "Supernumerary Assistant Collector" means a Junior Indian Administrative Service Officer allotted to the Maharashtra Cadre on probation
  1. (1) Every Probationary Deputy Collector or Probationary Tahasildar shall have to pass the examination during the period of probation as per the training program prescribed by Government and within three chances.

    (2) Any person who fails to pass the Examination within the period of probation or the number of chances mentioned in sub-rule(1) shall be liable to be discharged from the service;

    Provided that in exceptional circumstances, Government may, in its discretion, grant not more than two extra chances to appear for the examination by extending the period of probation.
  2. Every Supernumerary Assistant Collector, on his appointment, shall have to pass the examination within the period of probation.
  3. Every person who has passed the Examination held before the commencement of these Rules, in accordance with any rules similar to these Rules, shall be exempted from passing the examination.
  4. The Examination shall be conducted by the Commission twice every year in the month of April and October. The candidates will be allowed to answer the papers in Marathi and or English.
  5. The Syllabus for the Examination shall be as mentioned in the Appendix to these rules or as the State Government may by order, from time to time direct.
  6. (1) The subjects of the Examinations shall be arranged under three heads, namely Judicial, Revenue and Accounts:-
  1. The Judicial Head shall comprise of one paper which will carry 100 marks.
  2. The Revenue Head shall comprise of four papers and each paper will carry
  3. 100 marks .

  4. The Accounts Head shall comprise of one paper which will carry 100 marks.

(2) The standard of passing the Examination in each Head shall be 50 per cent of the total number of marks for that Head.

  1. Any candidate who appears in all Heads at one and the same examination, but fails to obtain required minimum number of marks for passing in only one Head shall be entitled to have his deficiency condoned under that Head if the deficiency does not exceed five per cent, of the total marks obtainable under that Head.
  2. An unsuccessful candidate who has obtained sixty per cent or more of the total number of marks obtainable under any Head shall be entitled to have his deficiency condoned under that Head if the deficiency does not exceed five per cent of the total marks obtainable under that Head.

    Provided that, for obtaining the exemption the candidate shall make written application before appearing for the subsequent Examination;
  3. Provided further that, if no such written application is made, it will be presumed that the candidate does not desire to claim such exemption.

  4. A candidate who appears in all Heads at one and the same Examination and obtain at least 75 per cent, of the aggregate number of marks obtainable shall be considered to have passed the Examination with credit.
