Maharashtra Revenue Qualifying Examination for promotion to the post of Awal Karkun from the cadre of clerk Typist Rules 1999.
In exercise of the powers conferred by the provision to article 309 of the Constitution of India and in supersession of all the Existing rules orders or instruments issued in this be half and force in the State or any part thereof the Governor of Maharashtra is hereby pleased to make the Following revenue Qualifying Examination for promotion to the post of Awal Karkun from the cadre of Clerk typist rules under the Revenue and Forests Department of the Government of Maharashtra namely-
- Short title. – These rules may be called the Maharashtra Revenue Qualifying Examination for promotion to the post of Awal Karkun from the cadre of clerk Typist Rules 1999.
- Definitions - In these rules unless the context requires otherwise,-
- "Appendix" means Appendix to these rules;
- "Appointed Date" means date of coming into force of these rules ;
- "Awal Karkun" means an Awal Karkun and includes Treasury Awal Karkun Deputy Chitnis and Shirastedar as specified under the Maharashtra Revenue Department Awal Karkun (Recruitment) Rules, 1996;
- "Clerk Typist" Includes Junior Clerk, Election Inspector and Junior Auditor in a revenue Officer in any division;
- "Departmental Examination" means the sub-service Departmental Examination or revenue Clerks Departmental Examination and includes any other Examination declared by the Government for confirmation in service for clerks and posts included in the cadre of clerk;
- "division" means the Revenue division constituted under section 3 of the Maharashtra Land Revenue Code 1966 (Mah. XLI of 1966).
- "Examination" means Revenue Qualifying Examination for promotion to the post of Awal Karkun from the cadre of Clerk Typist under the Revenue and Forest Department of the Government of Maharashtra ;
- "Secondary School Certificate Examination" means the final examination conducted at the end of secondary stage of education by a Divisional Board under the Maharashtra secondary and high secondary education boards act 1965 (Mah. XLI of 1965) at the end of the Secondary stage of education as defined in that Act And includes any other Examination declared by Government to be equivalent thereto;
- Necessity of Passing Examination – Every Clark Typist whether appointed by promotion or by nomination before after the appointed date unless exempted from passing the Examination under rule 5 shall be required to pass the Examination for being eligible for promotion as Awal Karkun in accordance with the provisions of these rules.
- Eligibility to appear for Examination – Every Clerk Typist who has,-
- completed not less than three years continuous service in his post and
- passed the sub-service Departmental Examination or revenue Clerk Departmental Examination as the case may be shall eligible to appear for the Examination.
- Exemption from Passing Examination – The Following persons shall be exempted from passing the Examination-
- a person who has already been confirmed in the post of Awal Karkun, proper or other posts included in the cadre of Awal Karkun before the appointed date;
- a person who has already passed the revenue Qualifying Examination before the appointed date;
- a person who has attained the age of forty-five years on or after the 1st Day Of November 1977;
Provided that once the seniority lost by him in accordance with the provisions of rule 7, shall not be restored on account of such exemption.
- Period and number of chances for passing Examination:- A Clerk Typist shall be required to pass the Examination within three chances and within nine years of his continuous service.
- Effect of passing examination on seniority:- A Clerk Typist who has passed the Examination in accordance with the provision of rule 6, shall retain his original seniority. If he fails to pass the Examination within three chances and nine years, then he will lose his seniority to all those Clerk Typists who have passed or are exempted from passing of the Examination, before him, as well as to those Clerk Typists who are senior to him and who may pass the Examination after him; but within prescribed period and chances specified in these rules.
- Chances for appearing Examination:- Subject to the provisions of rules 6 and 7, a Clerk Typist may avail any number of chances for appearing the Examination.
- Examination when to be held and language of papers:- The Commissioner of a division shall conduct the Examination and ordinarily it shall be held twice a year, on such dates and places, as may be decided by him. The Candidates shall answer the papers in Marathi language only.
- Consequences when Examination is not held:- If for any reasons, the Examination is not held in a particular half year, that period shall be excluded while computing the chances mentioned in rule 6.
- Syllabus:- The syllabus for the Examination and maximum number of marks allotted for each paper shall be as mentioned in Appendix 'A'.
- Standard of passing:- The standard of passing the Examination shall be 50 per cent of the total marks, in each subject.
- Exemption in subject:- A Clerk Typist who fails to pass the Examination but secured 55 percent or more marks in any subject, shall be exempted from passing for that subject at any subsequent Examination. The candidates who has secured exemption in any subject, has to specifically claim it at the time of appearing at any subsequent Examination by applying for it and if the exemption is not so claimed, it will be presumed that the candidate has not availed of such exemption.
- Credit :- (1) A Clerk Typist who passes the Examination in first attempt and secures 70 per cent or more marks in any paper, an entry regarding his performance in that paper shall be recorded in his Confidential Record;
(2) A Clerk Typist who passes the examination in all papers at once and the same time and secures 70 per cent or more of the aggregate mark shall be considered to have the examination with credit and an entry regarding his performance shall be recorded in his confidential record;
Provided that, a Clerk Typist who has secured an exemption in any subject, in accordance with the provisions of rule 13, and passed the Examination at any subsequent attempt in the remaining subjects shall not be considered to have passed the Examination with credit.
- Determination of Seniority:- Subject to the provisions of rule 7, the seniority of a candidate may be fixed on the basis of the date of passing of the Examination for the purpose of qualifying for promotion to the post in the cadre of Awal Karkun. As among the candidates who pass the examination, the date of continuous service in the post shall determine the seniority and in case it is the same, the candidate older in age shall be declared as senior.
- Application Form for appearing in the Examination:- Every Clerk Typist who desires to appear for the Examination shall apply, in writing the Form prescribed in Appendix 'B' to the Collector.
