SUPERIOR COURT OF THE STATE OF WASHINGTON

IN AND FOR THE COUNTY OF KING

LARRY PITTMAN, et al.,

                                    Plaintiffs,

                        v.

KING'S COMMAND FOODS, INC.,

                                    Defendant.

No. 99-2-52345-8 KNT

DECLARATION OF sidney lanier IN SUPPORT OF mary coleman in OPPOSITION TO DEFENDANT’S MOTION for summary judgment

Note for Hearing with Oral Arguments

Friday, January 18th, 2002 at 9:00AM

I, Sidney Lanier, one of the plaintiffs in the above captioned case, declare as follows:

I knew Mary Coleman as a coworker at King's Command Foods., though I did not work with her directly, I was around in the packing room when she complained how they misused her and she felt she was treated unfairly work assignments and breaks, when white workers get more favorable assignments and were allowed to take longer breaks.  She was senior employee there, but she was assigned to the lesser and demeaning jobs.  On a consistent basis the white workers would get there better positions.  She did complain about how she was treated and they didn’t offer her a chance to move up.

She would  come in early to help with the set-up without pay.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.

Dated this 13th day of January, 2002.
