I, Sidney Lanier, one of the plaintiffs in the above captioned case, declare as follows:

I worked off and on with Keith Kerns at King's Command Foods and observed constant racial harassment from Kirk McCoy, consisting of continually calling him "Boy."  They put a lot of pressure on Keith and I believe this was because he is black and they did not like him.  The name calling was on a daily basis.  Keith got the worst job assignments and he got paid less than me in spite of the fact he had more seniority than me.  Most of the work that was strenuous work was given to Keith.  This was particular hard for him when he was sick and had kidney failure going on.  Robert would stand over him and cuss at him, calling him stupid and "Nigger."  It was a sad situation and the company just let it go.  Robert was his supervisor, one of the managing people for King's Food Command at the plant.  Kirk McCoy was around and he had to hear this when it was occurring because it would have been impossible not to.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.
