DECLARATION OF sidney lanier IN SUPPORT OF GREG CODY in OPPOSITION TO DEFENDANT’S MOTION for summary judgment

Note for Hearing with Oral Arguments

Friday, January 25th, 2002 at 9:00AM

I, Sidney Lanier, one of the plaintiffs in the above captioned case, declare as follows:

I worked with Greg Cody at the end of the shift and witnesses the fact that Greg Cody would come in at the end of the shift and Robert Thomas was going off the shift.  Robert Thomas had at times not completed his work and it had to be done by Greg Cody.  Robert Thomas was never wrote up for loafing as Darryl was once.  Robert Thomas was a white worker and he would just leave when his shift was done.  It was my observation that the Black workers were not allowed this leeway.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.

Dated this 6th day of January, 2002.
