I, Sidney Lanier, one of the plaintiffs in the above captioned case, declare as follows:

I have worked with Darrell Cody and I have personal knowledge that Kirk McCoy would hassle Darryl and complain about the job he was doing, when there was no basis for it.  It was unwarranted criticism, that he would not do to white workers at the plant in the same position or circumstance.  They talked down to Darrell and downplayed his work and in contrast they would not do the same to the white workers.

In fact there was time when they took Larry Shockley, a white worker, and praised him when he was drunk and then they would talk to Darryl Cody like he was worthless and demean him.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.
