SUPERIOR COURT OF THE STATE OF WASHINGTON

IN AND FOR THE COUNTY OF KING

LARRY PITTMAN, et al.,

                                    Plaintiffs,

                        v.

KING'S COMMAND FOODS, INC.,

                                    Defendant

No. 99-2-52345-8 KNT

DECLARATION OF LARRY PITTMAN IN SUPPORT OF Darrell cody’s  OPPOSITION TO DEFENDANT’S MOTION for summary judgment

Note for Hearing with Oral Arguments

Friday, January 18th, 2002 at 9:00AM

I, Larry Pittman, one of the plaintiffs in the above captioned case, declare as follows:

Darrell was the only Black machine operator in the plant.  He was shop steward and we went to him for help about racial problems.  When Kirk McCoy had to take an absence Darrell would fill in for him in the same position, but never could get the same rate of pay.  I heard Kirk McCoy talking to Darrell using the same tone of voice that he used toward all blacks, which was talking down to.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.

Dated this 13th day of January, 2002.
