SUPERIOR COURT OF THE STATE OF WASHINGTON

IN AND FOR THE COUNTY OF KING

LARRY PITTMAN, et al.,

                                    Plaintiffs,

                        v.

KING'S COMMAND FOODS, INC.,

                                    Defendant

No. 99-2-52345-8 KNT

DECLARATION OF LARRY PITTMAN IN SUPPORT OF OTHER PLAINTIFFS OPPOSITION TO DEFENDANT’S MOTION for summary judgment

Note for Hearing with Oral Arguments

Friday, January 18th, 2002 at 9:00AM

I, Larry Pittman, one of the plaintiffs in the above captioned case, declare as follows:

I have read the declaration of Shabae Diquan and would support his statements that racial name calling was part of the environment.  The name calling and racial slurs were part of the ordinary environment tolerated by the management team consisting of Terry Smith, Kirk McCoy and Tim Marciwitz.

I went to Interim Temporary Employment Agency.  I told them my name was Larry Pittman and I told them they had sent me to King's Command Foods, Inc. before.  They remembered me and said the she stopped sending people to King's Command because they discriminated.  Interim's policy was not to discriminate and they had talked to King's Command about it, but it never stopped.  I immediately went to my attorney's office, Paul King.  Mr. King sent Mark Rosenquist, an investigator with his law firm, and myself back to Interim.  We spoke with Pachia Paul and she confirmed everything I had been told earlier by Interim.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.

Dated this 6th day of January, 2002.
