DECLARATION OF LARRY PITTMAN IN SUPPORT OF SYlVESTER PITTMAN OPPOSITION TO DEFENDANT’S MOTION for summary judgment

I, Larry Pittman, one of the plaintiffs in the above captioned case, declare as follows:

I sent my brother, Sylvester Pittman, down to King Command Foods, Inc., to get a job because Terry Smith had told me that they needed somebody to work.  Sylvester went and couldn’t even get an application.  I asked Terry Smith why he didn’t get an application he said, "Oh no, not him."  Shortly after Sylvester was turned down they hired another person for the job.  There appeared to be no reason why he was not given a application.  They were hiring for a number of positions.

In addition, on going through the interrogatories, on page KCF01559, it is shown that a Mary Bartolome in Laundry was working part-time, twenty hours per week.  Even though Sylvester was willing to work full or part time, there was part time work available and defendant was not accurate in their statement that they never have part time jobs.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.
