DECLARATION OF LARRY PITTMAN IN SUPPORT OF RELASHIA SEARLES OPPOSITION TO DEFENDANT’S MOTION for summary judgment

I, Larry Pittman, one of the plaintiffs in the above captioned case, declare as follows:

I have known Relashia for sometime.  I joined the workforce of King’s Command Inc., in November 1996, at that time they were hiring for the positions that Relashia had worked at worked and it appeared that they had building workforce at that time.  Since they were in the midst of building up there labor force and providing more labor in her area, there appears to be no reason not to give her a application for employment.  They normally receive applications during that time and until I left,  through the direct supervisor, in this case it was Tim Markewicz.   In a note to the judge this the same person that was making racial jokes and slurs about Sidney Lanier and other Blacks in the workplace.  That is the person that she asked for the application, and I know this because he was the night supervisor and I recognize her description of him and he was charge when I started.  In order for a person working nights to get position, they would have to apply  through there foreman and the foreman would relay to Terry Smith who would hire the person. 

I only told Relashia about the suit in the year 2000 and she joined shortly thereafter.

Applications for employment could be oral or written at that time and he could have accepted it if he felt like it.

The defendant has admitted that they did not keep applications for employment, except for the person that was hired and kept no applications for  promotion.  In fact they tore up my requests for promotions in front of me.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.
