I, Greg Cody, one of the plaintiff’s in the above captioned case, declare as follows:
I worked with Curtis Hollis while he was at King’s Command Foods, Inc. I was his line leader as he was on the same floor as I was. He was hired as a meat grinder. He had some time that he was off work, one time. I witnessed several occurrences of what I perceive as discriminatory behavior. Curtis had court dates related to traffic violations, but he always told management in advance. His supervisor, Jim Markewicz, wrote him up for not being there anyway.
Another problem he had was that there was an accident on the freeway. A state patrolman was hit by a car and both sides of the freeway were closed. This caused him to be two hours late. Management wrote him up for this. Curtis went and got a police report and brought it in. In spite of providing a valid excuse, they still kept the write-up on his work record.
One day the police arrested him for having an open beer bottle in his car. This happened on a military base, and he had to go for alcohol treatment. King's Command told him it was OK to take the time off work for the treatment. When he came back to work after treatment, King's Command had him fired. Terry Smith terminated him.
Every time he was late, he had documentation for the reason he was late. They terminated him anyway. They did this because of his color, not performance.
