LARRY PITTMAN, et al.,

                                    Plaintiffs,

                        v.

KING'S COMMAND FOODS, INC.,

                                    Defendant

No. 99-2-52345-8 KNT

DECLARATION OF GREG cody IN OPPOSITION TO DEFENDANT’S MOTION for summary judgment

Note for Hearing with Oral Arguments

Thursday, Friday 7th, 2002 at 9:00AM

I, Greg Cody, one of the plaintiff’s in the above captioned case, declare as follows:

When I was terminated it was by Mr. Markewicz on what I believe was the 28th of June, 2000.  I called him on the phone and he told me that he had to terminate me because I unable to call or come to work.  He never gave me a chance talk to Terry Smith on the reasons I had been absent.  Other white workers were given a chance to present their case to Terry Smith.   I feel that they terminated me because I was a part of this lawsuit.

After I was terminated King's Command tried to deny my unemployment and I had to go in front of a judge and won my case.  The judge also said that it wasn’t good enough reason to terminate me.

I certify under the penalties of perjury under the laws of the State of Washington the foregoing is true and correct.

Dated this 26th day of January, 2002.
