DECLARATION OF Darrell cody IN OPPOSITION TO DEFENDANT’S MOTION for summary judgment regarding ben barnes

I, Darrell Cody, one of the plaintiff’s in the above captioned case, declare as follows:

I worked with Benjamin Barnes while he was at King’s Command Foods, Inc.  He was on the same floor as I was.  He was hired as lead person in shipping.  From the beginning the white employees that he had made his job duties difficult.  They would pull wrong order.  We believe that it Dwight Smith doing this.  He was setting it up wrong on the inside of the pallets we believe because they wanted a different white supervisor or the previous white supervisor, who is Bill Spenson, who did come back and is currently working there now.  Before Ben Barnes there was no problem with the order being screwed up, it was only when Ben Barnes was there.  The orders were screwed up in the middle of the pallets, not the sides where it would be detected.  This appeared to be done deliberately to hurt Ben Barnes.  Most Black’s thought it was deliberate. 

Robert Thomas was also calling Ben Barnes racial epithets.

When Ben Barnes quit, Elliot, a white worker, had pulled  a knife on him and threatened him.  Ben came to me on the cook line one and told me about it.  I told him to go to Terry Smith, King’s Command Foods’ Plant Manager, which he did.  Ben came back and reported that Terry Smith had told him “if you don’t like it, go work somewhere else”  He was tears.

No occurrence was given to Elliot.
