I, Judith Calhoun,
declare,
I reviewed Defendant’s responses to Plaintiff’s First Set of Interrogatories and Requests for Production. In four separate interrogatories, Defendant stated either that there no merit raises or referred us to the union contract which shows seniority as the only basis for promotion. Defendant made false statements. Following are a list of merit raises from the same set of interrogatories propounded to Defendant. What is also evident from reviewing the list of merit raises is obvious disparate treatment. Out of 141 merit raises, only three are to blacks.

The four interrogatories and responses referred to follow:
Interrogatory No. 552: “Have certain job categories provided for merit pay raises (during the relevant time period)?” Answer” l No. Pursuant to CR33c, see the 1996-1998 Agreement By and Between King’s Command Foods, Inc. and King’s Command Meats, Inc. Employee Association and the 1998-2002 Agreement By and Between King’s Command Foods, Inc. and United Food and Commercial Workers Union, Local 81, AFL-CIO, ;which were provided with the Answer to Interrogatory No. 43, See also Answer to Interrogatory No. 545”
Then referring to Interrogatory No. 43: Did the defendant ever have any policy (during the relevant time period) which excluded minority groups from employment or otherwise discriminated against such persons regarding terms or conditions of employment? Answer: No. [refers to union contract]
and Interrogatory 545: Please identify and describe all forms of compensation that may be provided to an employee, above the employee’s base wage or salary” Answer does not contain a category for Merit Raise.
Then see also Interrogatory 554, Answer: “There is no merit pay.”
