| This Agreement is entered into this ______day of 20___ between Tanya Webster residing at 158 Laurel Ln, Gillett Pa 16925 herein referred to as Trainer and residing at herein referred to as Owner. Whereas that Owner owns the below described horse and wishes for Trainer to train said horse under the terms here to agreed as follows 1 Horse Information a Description Name Age Sex breed Description (please include markings and scars) Herein the above described horse will be referred to as Horse b Previous Training Has Horse had any previous training? If yes please describe below, if Horse has no previous training or training is unknown, please write none or unknown. c Health and soundness Does Horse have any health conditions, old injuries, or past soundness issues that could affect training? If yes, please describe below, if no, please write none. d Vices or Behaviors Does Horse have any vices or behaviors Trainer should be aware of? Kicking, biting, charging, pulling back while tied or any other behaviors that could pose a danger to Horse, Trainer, or any of the trainers agents? Please include any other contact information and instructions 3 Housing a Housing Options Horse may be kept in pasture with other horses, singly or in a stall. Trainer will use her judgment in choosing a housing situation for the Horse. If Owner does not want Horse to be turned out with other horses, please write no herd turnout. b Feed and Care Trainer agrees to provide adequate feed and facilities for normal and reasonable care required to maintain the health and well-being of the animal in training. If Horse requires any special feed, supplements, or medications, Owner must provide them to the Trainer upon the arrival of the Horse. 4 Terms of Payment a Owner shall pay a training fee of: (check one) : Weekly fee of $84.00 per week ($12.00 per day) : ___ days of training for the fee of ____________ b Training on a weekly basis is due upon the arrival of Horse and at the beginning of each week there after. For ____ days of training _________ is due upon the arrival of Horse and the remaining fee of _________ is due upon completion of the training before the horse is picked up. c Expenses Owner agrees to pay any and all farrier and veterinary expenses incurred while horse is in the trainer's custody within 30 days from date Owner receives notice of veterinary or farrier treatment. 5 Veterinary and Farrier a Trainer assumes responsibility for arranging veterinarian and farrier services as deemed necessary for proper care of Horse. Trainer will use a veterinarian and farrier of her choice to provide ordinary and necessary care unless Owner has requested his or her own veterinarian and farrier be used. However, if they are unavailable, Trainer will engage his choice. All veterinarian and farrier expenses, including medications, shall be paid by Owner as further described herein. b Please list the contact information of preferred vet and farrier if owner does not object to Trainer's choice please write none. Veterinary Name: Veterinary Number: Farrier Name: Farrier Number: *Please notify your veterinarian and farrier where Horse will be and make sure that they will travel to the location of Horse. c Health Owner must show current coggins and vaccination records for Horse. Trainer reserves the right to refuse any horse if Horse does not appear to Trainer to be in good health or is deemed dangerous or undesirable. 6 Emergency Care Trainer agrees to attempt to contact Owner should Trainer determine veterinary treatment is needed for Horse, but if Trainer is unable to contact Owner, Trainer is then authorized to secure emergency veterinary, and farrier care required for the health and well-being of horse. All costs of such care secured shall be paid by Owner within thirty (30) days from date Owner receives notice thereof, or Trainer is authorized, as Owner's agent, to arrange direct billing to Owner. Trainer shall assume that Owner desires surgical care if recommended by veterinarian in the event of colic, or other life-threatening illness, unless Trainer is instructed here in by Owner. Please note any limitations in veterinary care on the lines below. 7 Training of Horse The Trainer shall train Horse and perform all services in accordance with generally accepted professional standards. Trainer cannot and does not guarantee the effect of the training program or that any particular results will be achieved, since this depends a great deal on the individual physical and mental ability of each horse. Trainer shall furnish all labor, provide suitable facilities and care for Horse in an adequate manner with feed being determined by the Trainer. The Trainer has complete control over the manner of training and shall take all precautions for the proper performance thereof. 8 Release of Liability a Risk of Loss During the time that Horse is in custody of Trainer, Trainer, her agents, employees, or property owners shall not be liable for any sickness, disease, theft, death or injury which may be suffered by Horse or any other cause of action whatsoever, arising out of or being connected in any way with the boarding of Horse. This includes, but is not limited to, any personal injury or disability Owner, or Owner's guest, may receive on the premises being used for training. b Insurance The Owner fully understand that Trainer does not carry any insurance on any horses not owned by her for boarding or for any other purposes, whether public liability, accidental injury, theft, or equine mortality insurance and that all risks, connected with boarding, training, or for any other reason for which Horse is in the possession of Trainer, are to be borne by the Owner. c Inherent Risks and Assumption of Risk The undersigned acknowledges there are inherent risks associated with equine activities such as described below and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include but are not limited to the propensity of equines to behave in ways such as running, bucking, biting, kicking, shying, stumbling, rearing, falling or stepping on, that may result in an injury, harm or death to persons on or around them; the unpredictability of equine's reaction to such things as sounds, sudden movement and unfamiliar objects, persons, or other animals; certain hazards such as surface and subsurface conditions; collisions with other animals; the limited availability of emergency medical care; and the potential of a participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participant's ability. Owner expressly releases Trainer, her agents, employees, and/or property owners from any and all claims for personal injury or property damage. WARNING You are advised that there are inherent risks, including the risk of serious injury or death, while engaging in equine activities. By engaging in equine activities and in accordance with the terms of this agreement you hereby assume all risks of injury or death. d Hold Harmless Owner agrees to hold trainer harmless for any and all claims arising from damage or injury caused by said horse to anyone, and defend Trainer from any such claims. Owner agrees to disclose any and all hazardous and dangerous propensities of horse boarded with Trainer. Trainer reserves the right to notify owner within seven (7) days of horse's arrival if said horse, in Trainer's opinion, is dangerous, untrainable, unhealthy, handicapped or otherwise unfit for training. Upon such notification, Owner shall remove said horse within seven (7) days, and all expenses incurred for horse's stay shall be paid prior to departure. Upon payment of all fees, this contract shall be deemed terminated. 9 Right of Lien The Owner is given notice that Trainer has a right of lien as set forth in the laws of the State of Pennsylvania, for the amount due for training fees and expenses incurred in the training of Horse and shall have the right, without process of law to retain said horse and other property until the amount of said indebtedness is discharged. However, Trainer will not be obligated to retain and/or maintain the horse in question in the event the amount of the bill exceeds the anticipated unregistered value of the horse. In the event Trainer exercises Trainer's lien rights as above-described for non-payment, this Agreement shall constitute a Bill of Sale and authorization to process transfer applications from any breed registration as may be applicable to said horse upon affidavit by Trainer's representatives setting forth the material facts of the default and foreclosure as well as Trainer's compliance with foreclosure procedures as required by law. In the event collection of this account is turned over to an attorney, Owner agrees to pay all attorney's fees, costs, and other related expenses for which a minimum charge of $250.00 will be assessed. 10 Entire Agreement This contract represents the entire agreement between the parties. No other agreements, promises, or representations, verbal or implied, are included herein unless specifically started in the written agreement. This contract is made and entered into in the state of Pennsylvania and shall be enforced and interpreted in accordance with the laws of said State.
