| 1 This agreement, made and entered into this______day of____________20 by and between _____________ residing at__________________________________Hereinafter referred to as "Mare Owner" and Tanya Webster residing at 158 Laurel Ln. Gillett Pa 16925. For the purpose of this contract vices will be defined as biting, kicking (of stall, human, or other horse), cribbing, weaving or any other vices that may cause harm to horse or handler. If so please list below, if not please write none. _________________________________________________________________________________ _________________________________________________________________________________ _________________________________________________________________________________ 4 Booking Fee: Upon payment of : $50.00 booking fee, which is not refundable, Breeder does here in by reserve for the Mare Owner one season's booking for the 2006 breeding season to the above described stallion for the services of the above described mare. 5 Mare Care a The mare shall remain in the custody of the Breeder for a sufficient time to become in season and be covered by the stallion. b Board at the rate of ___ dollars per day for keeping and ordinary care of the mare and/or foal will be paid by the Mare Owner c The balance of the breeding fee of $200.00 plus all unpaid board and expenses will be paid when the mare is picked up. d Breeder agrees to provide the following for the fees indicated: e Hay will be provided when the mare is not turned out to pasture or if the pasture is inadequate to support mare and/or foal at her side. f Grain: Any special grain or supplements the mare requires should be provided to the Breeder by the Mare Owner at the time the mare is dropped off for breeding. Amounts per feeding should be indicated below by Mare Owner and how often the mare requires feeding and supplementation. Grain: _____________________________________________________________________________________ Supplements: _______________________________________________________________________________ g Stall: A 10 X 10 stall with a concrete floor and sawdust for bedding will be provided for the mare and/or foal for use as necessary h Turn out Unless otherwise specified or requested by Mare Owner, 24 hour turnout will be provided for mare and/or foal at side unless doing so will knowingly endanger either mare and/or foal or inclement weather prevents turnout. 6 Health Certificates Mare Owner agrees that the mare shall be in a healthy and sound breeding condition, free form infectious, contagious or transmissible disease. Upon arrival, all mares shall be accompanied by a health and rabies certificate and current coggins, as well as any certificates of registration necessary for registration of the resulting foal. 7 Expenses The Mare Owner agrees to allow Breeder to have a qualified veterinarian examine or perform such other veterinary services that Breeder may deem necessary for proper treatment and protection of the mare and/or foal at side. Said veterinary services shall be paid at the Mare Owner's expense and will be billed and paid prior to the mare being picked up. 8 Waiver of Liability Breeder will exercise judgment in the care and supervision on the mare and/or foal, however, during the time that the mare is in the custody of Breeder. It is understood that the breeding farm, it's owners, stallion owners, employees, veterinarians, and guests shall not be liable for any sickness, disease, theft, death or injury which may be suffered by the mare and/or foal at her side or any other cause of action whatsoever arising out of being connected in any way with the breeding or boarding of the mare and/or foal. This includes, but is not limited to, any personal injury or disability which the Mare Owner may receive while on the premises that the stallion or mare are being kept. The Mare Owner fully understands that Breeder does not carry any outside insurance on horse(s) that are in their possession for breeding and boarding, any public liability, accidental injury, theft or equine mortality insurance policy and that all risks connected with breeding and boarding of the mare(s) and/or foal at side are to be borne by the Mare Owner. The Mare Owner will not be responsible for any accident or injury to the stallion or other mares. 9 Guarantees a Settling Mare Breeder agrees to diligently try to settle mare; however, if mare fails to settle, for any reason, Mare Owner will hold Breeder blameless. Mare Owner agrees to give Breeder ample Opportunity to settle mare, including a minimum of three (3) breeding cycles. b Live Foal Guarantee For the purpose of this contract, a live foal shall be defined as one that stands and nurses without assistance. Breeder guarantees a return breeding the following season provided the stallion is able to service mares either for said mare or an approved substitute should a live foal not result from this mating. Written certification by a licensed veterinarian within two (2) weeks that the mare has slipped or produced a non-viable foal and that such abortion or death did not result from any omission of the Mare Owner. Failure to do this will void live foal guarantee. Rebreed privileges extended beyond the following year shall be subject to an additional fee. c In the event that the stallion is not able to re-service said mare, the Breeder may substitute another stallion at Mare Owner's option or all monies paid by mare owner for previous service, not including expenses, shall be refunded to Mare Owner within 30 days of written request. For the purpose of this contract, expenses are defined, as but not limited to, mare care, veterinary services and booking fees. d In the event that the mare is unable to conceive or unfit for a rebreed, the Mare Owner may substitute another mare with the breeder's option or all monies paid by mare owner for previous service, not including expenses, shall be refunded to Mare Owner within 30 days of written request. e A "Breeder's Certificate" will be issued for the foal, conceived by this mating when the stallion fee and all other expenses have been paid in full and the mare has produced a live foal by this mating or the mare has been pronounced safe in foal by a veterinarian. 10 Mares that are not halter broken or cannot me hobbled, handled, or housed safely will not be accepted. 11 Mares should have hind shoes removed before arrival. If they are not removed, they will be removed by our farrier at the owners expense. 12 Other ______________________________________________________________________________________ ______________________________________________________________________________________ ______________________________________________________________________________________ ______________________________________________________________________________________ ______________________________________________________________________________________ ______________________________________________________________________________________ 13 This contract is governed by and shall be constituted under the laws of the state of Pennsylvania 14 This contract shall not be assigned or transferred by either party here to without the consent of the other. If the mare is to be rebred and the mare owner fails to deliver her for breeding the following year, than any and all fees paid shall not be refundable and contract is there by cancelled 15 This Contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied, are included unless specifically stated in the written contract.
