| Bylaws and Covenants, Conditions, & Restrictions (CCRs) of the Packard Estates Homeowners Association, Inc. |

| The Bylaws provide details concerning the affairs of the Packard Estates Homeowners Association (the "Association"). Specifically, it directs how the Association will form a Board of Directors and Committees as well as how voting, quorums, and proxies will be conducted. This document is particularly important in that it discusses the "powers and duties" of the Board of Directors as well as the responsibilities of each position. Equally important is Section VI, Obligations of Owners. CCRs are a legally recorded document provided to each homeowner by their Title company at closing. It is the responsibility of each homeowner to ensure they receive a copy of the CCRs and abide by the rules set forth. As per paragraph 1.7, the purpose is to: "Set forth the basic restrictions, covenants, limitations, easements, conditions, and equitable servitudes (collectively "Restrictions") that apply to a Tract. The Restrictions are designed to preserve the Property's value, desirability, and attractiveness, to ensure a well integrated high-quality development, and to guarantee adequate maintenance of the Common Area, and the Improvements located theron, in a cost effective and administratively efficient manner." Properly drafted Bylaws and CCRs that are willingly acknowledged by all homeowners and properly enforced raise the value of every home in the neighborhood and provide a higher quality of life. Because the neighbors are responsible for conducting their own affairs, both the Bylaws and CCRs provide provisions for amendments should the majority of homeowners desire a change. You should have received a copy of the CCRs during your closing. Please contact your title company if your closing document packet does not contain a complete copy of the CCRs. | The most commonly violated CCRs are homeowners constructing fences, placing sheds, playground structures, patio lattice or other screening materials, etc. on their property without ACC approval or storing RVs, trailers, etc., that can not be screened from view. Please, for your protection and the continued quality of our neighborhood, submit ALL plans for any improvement or addition to the ACC. | |||||||||
| Some of the more common CCR Restrictions that affect every homeowner are detailed in Section IV: GENERAL AND SPECIFIC RESTRICTIONS. Below is a summary of some of these restrictions. 1. All lots are to used for single-family residential homes. Minimum size is 1600 sq ft excluding garage for a one story home, 2000 sq ft minimum for a two story with 1200 sq ft minimum on the ground floor. 2. Any improvements which will be visible above ground can not be built, erected, placed, or materially altered or removed from the Property unless and until the building plans, specifications, and plot plan or other appropriate plans and specifications have been reviewed in advance by the Architectural Committee. 3. Garages, sheds, patio covers, shall be constructed of, and roofed with similar colors and design, as the residential structure. 4. No playhouses, playground equipment, pool slides, diving boards, hot tubs, spas, or similar items shall estend higher than 5 ft above finsished graded surface of the Building Lot unless approved by the Architectural Committee. 5. Basketball courts, backboards, pools, tennis courts, shall be allowed in the backyard of any Building Lot provided such amenities are approved by the Architectural Control Committee and do not promote noise or other nuisance that is offensive to the occupants of such other property. Mobile basketball hoops may be allowed in the front driveway as long as they are maintained in good repair and do not promote noise or other nuisance that is offensive to the occupants of such other property. (Meridian City Code prohibits any obstruction, including mobile basketball hoops, on any sidewalk or street.) 6. All fencing and boundary walls constructed on any Building Lot must first be approved by the Architectural Control Committee. Fence designs shall not extend into any common green space within the subdivision. Fences and boundary walls must be of compatible style and material to that of adjacent Building Lots and should be constructed of cedar planks utilizing a picture frame style. Fencing shall not extend higher than six (6) feet above the finished grade surface of the Building Lot or extend past the front setback of the home. All fencing must meet the setback requirements of City ordinance. 7. No exterior radio antenna, television antenna or other antenna of any type shall be erected or maintained on the property unless approved by the Architectural Committee. No large satellite dishes. Small ones, like DirecTV or DISH are OK if they are not visible from the street. Of course these must also be approved by the Architectural Committee. 8. No sign of any knid shall be displayed to the public view without the approval of the Architectural Committee. Residential For Sale signs are OK. See CCRs for details and other restrictions. 9. No rubbish or debris of any kind shall be placed or permitted to accumulate anywhere upon the Property. No noise or other nuisance shall be permitted. Unless approved, no exterior speakers, horns, whistles, bells, or other sound devices, flashing lights, or search lights, shall be located or used on the Property. 10. No improvement shall be permitted to fall into disrepair to include landscaping. Should any improvement fall into disrepair so as to create a dangerous, unsafe, unsighhtly, or unattractive condition, the Board of Directors has the right to correct such condition and to enter upon such Owner's Building Lot. Such Owner will reimburse the Association for the cost thereof. 11. No hazardous activities shall be conducted which might be unsafe to any person or property. 12. No unsightly articles shall be permitted to remain on any Building Lot. Refuse, garbage, and trash shall be kept at all times in such containers and in areas approved by Architectural Committee. Garbage cans must be removed from the street in a reasonable amount of time following the garbage pick up day. 13. No clothing or fabrics shall be hung, dried, or aired in such a way as to be visible to other Property. 14. No Equipment, treat pumps, compressors, containers, lumber, firewood, grass, shrub or tree clippings, plant waste, metals, bulk material, scrap, refuse, or tash shall be kept, stored or allowed to accumulate on any Building Lot except within an enclosed structure or as appropriately screened from view. 15. No house trailer, mobile home, tent (other than for short term individual use which shall not exceed one (1) week unless approved by the Association), shack or other temporary building, improvement, or structure shall be placed upon any portion of the Property. 16. No boats, trailers, campers, all-terrain vehicles, motorcycles, recreational vehicles, bicycles, dilipidated or unrepaired and unsightly vehicles, or similar equipment shall be placed upon any portion of the Property (including without limitation, streets, parking areas, and driveways) unless enclosed by a structure concealing them from view and approved by the Architectural Committee. 17. No on-street parking. Vehicles parked on a driveway shall not extend into any sidewalk, bike path, or pedestrian path. 18. No animals, birds, insects, pigeons, poultry or livestock shall be kept on the Property unless the presence of such creature does not constitute a nuisance. Dogs must be kept on a leash, curbed, and otherwise controlled at all times when such animal is off the premises of its owner. Owners will clean up any animal defication immediately from any Common Area or public right-of-way. See CCRs for restrictions on dog runs or other pet enclosures. 19. Landscape plans must be approved by Architectural Committee. Landscaping will be planted within thirty (30) days after dwelling is completed, weather permitting. Front landscaping shall include as a minimum, sod in front and side yards, two (2) deciduous trees of at least two inch (2") caliper or one (1) pine tree of at least six feet (6') in height and one (1) flowering tree of at least tow inch (2") caliper in front yard, ten (10) five (5) gallon shrubs or plants, five (5) two (2) gallon shrubs or plants and at least one (1) raised sculpered berm. |
