HOMEOWNERS ASSOCIATION OF OVERLOOK, INC. RULES AND REGULATIONS Revised 5/97 AUTHORITY The Bylaws of Homeowners Association of Overlook, Inc., authorize the Board of Directors to adopt uniform rules and regulations governing and restricting the use and maintenance of the property and improvements in the Overlook subdivision. ENFORCEMENT Violationsof the Governing Documents, including these Rules and Regulations, should be reported, in writing, to the management company. All infractions will be brought to the attention of the person or persons involved, by the management company, for correction. Repeated infractions and violations of a more serious nature will be referred to the Board of Directors for investigation and appropriate enforcement action. Disagreements concerning violations will be presented to the Board of Directors for adjudication and appropriate action. BICYCLES/MOTORCYCLES Bicycles may be ridden with the subdivision, but they must be kept inside garages when not in use. Motorcycles are not to be operated within the subdivision, except for access to and from garages. Motorcycles must be kept inside garages when not in use. Motorcycle engines may not be revved up and must be equipped with a muffler system in good operating condition. Outdoor recreation equipment, including but not limited to, basketball hoops/poles and trampolines, is prohibited within the Overlook community. Outdoor cooking facilities, such as gas or charcoal grills, shall be of portable style and shall be stored within the lanai or garage when not in use. DESTRUCTION OF PROPERTY Owners will be held responsible for destruction, damage, or defacement of building, facilities, and equipment caused through their own act(s) and/or the acts of their lessees or guests. SAFETY No one shall permit any activity or keep anything in a unit or elsewhere in the subdivision which would be a fire or health hazard or in any way tend to increase insurance rates. UNIT INTERIORS No owner may make any structural additions or alternation (except the erection or removal of nonsupport carrying interior partitions wholly within the unit) to any unit without prior written consent of the Board of Directors of the Association. SOLICITATION There shall be no solicitation by any person anywhere in the subdivision for any cause whatsoever unless invited by the owner to be solicited or specifically authorized by the Board of Directors. NOISE In order to insure your own comfort and that of your neighbors, radios, recording amplifiers, and television receivers must be turned to a minimum volume between the hours of 11:00 p.m. and 8:00 a.m. OBSTRUCTIONS Sidewalks, driveways, entrances, and all other areas of ingress and egress must not be obstructed in any manner and are to be kept free of any materials which would be unsightly or hazardous, including garden hoses, which should be coiled neatly out of sight from the street. PETS Two domesticated pets having a combined weight of not greater than fifty (50) pounds shall be permitted to be kept in a unit. No pit bulls, rottweilers or other fighting dogs will be permitted on any lot. No pet may be tied outside the unit at any time. The Board of Directors has the right to require proof of rabies Certificate and/or certificate of weight for any pet. If, in the sole judgment of the Board of Directors, it is determined that a pet is causing excessive disturbance and annoyance to other occupants, the owner will be required to dispose of the pet. In compliance with ordinances, pets will not be allowed in the common swimming pool area. All pet restrictions apply to guests in the Overlook community. OCCUPANCY No owner, lessee, or other occupant of a unit shall use the unit for purposes other than as a single family residence. Single family is defined as one or more persons related, by blood, marriage or adoption, or two persons living together as a single housekeeping unit. No owner/resident may divide the unit for the purpose of sale or lease. No occupant shall make any use of a unit which violates any laws, ordinances, or regulations of any governmental body. No occupant shall commit or permit any nuisance or immoral or illegal act in his unit or on the subdivision property. The units and recreational facilities are designed for maximum occupancy of two persons per bedroom in every unit. The occupancy of any unit in greater numbers must have prior written approval of the Board of Directors. PARKING Owners and lessees shall park their vehicles in the unit garage and/or driveway. Garage doors must be kept closed when not in actual use. No overnight parking on the street, parking on the grass, cul de sacs, or on sidewalks is permitted. SANITATION No garbage or refuse receptacle may be installed or maintained outside any unit except with the written permission of the Board of Directors of the Association. Occupants shall not allow any rubbish, refuse, garbage, or trash to accumulate in places other that the receptacles provided therefor, and each unit and lot shall at all times be kept in a clean and sanitary condition. Garbage shall be disposed of through the kitchen garbage disposal and compactor so far as possible, and all trash shall be placed in waterproof bags or similar containers before being placed in the appropriate receptacles. No debris or trash shall be swept or deposited from any unit onto the subdivision property. Garbage cans may be left out overnight, but all bags must be placed in cans. Empty receptacles must be returned to the inside of garages on same day as scheduled pick-up. SWIMMING POOL Owners, their lessees and guests, using the swimming pool and any other recreational facilities provided by the Declarant do so at their own risk. Persons using the swimming pool are requested to read and obey the posted rules for use of the swimming pool and patio area.
USE OF FACILITIES The recreational facilities are for the exclusive use of members of the Association, their house guests and lessees, and guests accompanied by a member or lessee. No guest or relative of a member or lessee may use the facilities unless in actual residence or accompanied by a member or lessee. In order to conserve the recreational facilities for the maximum enjoyment and pleasure of all concerned, the use of such facilities shall be limited to the person then in residence in any unit from time to time and their occasional guests. In the event a unit is rented, the tenant, his family and occasional guests may use such facilities to the exclusion of the owner of the unit and his family. Persons in residence in units owned by multiple or corporate owners shall be entitled to use such facilities during periods of such residence to the exclusion of the other multiple owners or corporate officials or their invitees. GARDENS Front-gated courtyard, and up to a maximum of six (6) feet from the rear of all buildings and sides of the end units may be planted with flowers or shrubs, at the owner's discretion. No vegetable gardening is permitted. All plantings shall be maintained by the owner in a well-ordered manner and shall not be permitted to become overgrown and unsightly. Any additional plantings must be pre-approved by the Board of Directors. HOLIDAY DECORATIONS Holiday decorations may be placed on the outside of a unit fifteen (15) days prior to the holiday. Any holiday decorations must be removed no later than fifteen (15) days after the holiday. MAILBOXES Mailboxes are maintenance responsbility of the Association. All repairs or replacements will be made by the Board of Directors as needed. No decorations or other objects my be attached to any mailboxes or posts. |
