On April 20th, 1977, the urdersigned, member of the Corporation of Quebecc Lard Surveyors, in order to prepare the present report, surveyed a one storey brick bungalow, bearing civic number 1100 Muir Street, in the City of Saint-Laurent.

Following this survey, donc upon the request of Me Steve Rosenoff, Notary, to put up to date a certificate of location prepared by Mr Marcel Huot, Q.L.S., on September 12, 1958, and considering that the servitude of bornage stipulated by Section 504 c.c. has not yet been executed, the undersigned certifies that in his opinion:

1.- The above bungalav, shown open the annexed plan, is located within lot number three of the subdivision of lot number one of the subdivision of original lot number two hundred and fifty-seven (257-1-3), of the cadastre of the Parish of Saint-Laurent, registration division of Montreal.

2.- Lot 257-1-3, of rectangular figure, measures fifty feet (50.0 ft) in width, by a depth of one hundred feet (100.0 ft), and has an area of five thousand square feet (5 000.0 sq ft), English measure.

3.- There are no reserves for public purposes registered against this lot.

4.- There is no encroachment of this property upon the neighbouring properties or vice versa, except what may be construed by the following:

a.- The Northwest end of the roof encroaches over lot 257-234 by 0.9 ft for its whole length, of approximately 34.0 ft.

b.- The property uses as landscaped ground the whole of the width of lot 257-234 (20.0 ft), for a depth of 100.0 ft.

At the front, an asphalt entrance is also partly located on lot 257-234 (see annexed plan).

c.- A rubblestone retaining wall, which in my opinion would belong to lot 257-233, encroaches on the back of lot 257-1-3, as shown upon the accompanying plan.

5.- There is no apparent servitude affecting lot 257-1-3.

6.- A1l the openings are in conformity with the minimum distances stated by sections 533 to 538 inclusive of the Civil Code.

It is to be noted nevertheless that 4 windows (direct views) are located at 1.37 ft from the part of lot 257-234, used as landscaped ground. These windows could be noi in conformity with the Civil code, depending upon the interpretation of the difficulty arising out of that strip of lot 257-234.

7. Lot 257-234 was officially deposited on October 30, 1967. The owner was and still is Shel1 Oil Company of Canada Limited. The part which is occupied by property 1100 Muir Street was, before the deposition of lot 257-234, known as part of lot 257-2 (lane). Shell acquired that part of lot 257-2 on June the 19th, 1957 (registration number 1278073) from Bourget Construction Inc. who had subdivided lot 257-2 as a lane.

The official deposition of lot 257-234 was not accompanied by a Municipal Resolution of the City of Saint-Laurent for the closing of lane 257-2, but only by a certificate of the City of Saint-Laurent, stating that the City had no objection to the cancellation of part of lot 257-2, without any mention of that being a lane.

On that part of lot 257-234, there exist aerial lines for Hydro-Quebec and Bell Telephone Company of Canada, as shown upon the accompanying plan. This is covered by a servitude.

8.- There is no mitoyen wall.

9.- No notice is presently inscribed on any Index to Immovables concerning this property stating that it is recognized under section 16, or stating that it is classified or within the protected area of any classified property under sections 26 and 28 of the Cultural Property Act.

10.- This building has been built according to Municipal Regulations governing zoning and situation and according to chapter 7, articles 2 to 8 of the Provincial Health By-Laws relating to Dwellings in general.

A plan is annexed to the present certificate of location.
