Accommodations Guarantee

The villa that you are renting from us is a timeshare unit. We own the right to use the particular unit(s) advertised, during set weeks in February of each year. As a renter, that right transfers to you, so you are guaranteed these accommodations.

All timeshare unit owners pay maintenance fees each year. Unless those fees are paid by the occupancy date, the timeshare unit cannot be used by the owner ,or by anyone else on behalf of the owner. We guarantee that the maintenance fees due on any unit rented from us, for February occupancy, will be paid no later than January 1st of the year of occupancy.

In the event that circumstances beyond our control prevent the use of the exact rental unit that we advertise, we reserve the right to work with The Ocean Club management to provide the renter(s) accommodations for the same time period, in a unit similar in size to, or larger than, the unit rented from us. Any such alternate accommodations will most likely be at, but are not guaranteed to be at, The Ocean Club. In the event that circumstances beyond our control prevent us from providing the actual rental unit that we advertise, or one similar to it, all rental monies paid to us will be refunded in full, unless the renter agrees to another unit if offered, and we and the renter agree upon, document, and sign the financial terms of any such exchange. We make no other guarantee against any financial loss that the renter may sustain due to such events.

Rental Fee Deposit

A deposit in the amount of 50% of the rental fee is required at the time of booking, to reserve a rental week. The other 50% of the rental fee will be due no later than December 1st. If the other 50% of the rental fee is not received by December 1st, we reserve the right to cancel the reservation, without return of any portion of the original deposit, in accordance with the cancellation policy as stated below.

Security Deposit

A $350 security deposit is required at the time of booking. The $350 security deposit will be refunded, once it has been confirmed with The Ocean Club management that the renter has left the unit in the same condition as when originally occupied, without any damage or missing items, and that the renter has settled all personal accounts charged to the unit being rented.

Other Fees

The renter shall be responsible for any room taxes or other miscellaneous government user fees in effect at the time of stay. Renters shall be advised that St. Maarten presently has in effect a government tax on these units, to be paid by the user, if and when the unit is occupied. This tax has not been in place all years, but at present is set at a flat fee of $50 per week for each of our rental units.

Renters shall also be advised that the St. Maarten government has in place an energy surcharge tax, applicable to all rental units, to be paid by the user if and when the unit is occupied. This energy surcharge tax has amounted to anywhere from $5 to $7 per day in recent years, sometimes depending on the size of the accommodations, and is presently set at a flat fee of $50 per week for each of our rental units.

Maximum Occupancy

Renters shall be advised that the maximum occupancy of any of our rental units is 4 persons, regardless of age.

Miscellaneous Charges

Renters shall be required to settle, upon check-out, all personal charges made by the renter(s) to the unit being rented (e.g. phone calls, car rental, computer room charges, Oasis Grille food and bar tabs, convenience store charges, etc.).

Condition of Unit

Renters shall fill out the customary Ocean Club unit inventory sheet, supplied to all guests at check-in time. The completed inventory sheet shall be submitted to The Ocean Club management at the Reception desk no later than the day following check-in. Renter(s) shall be held financially accountable for any missing or broken items not originally noted on the inventory sheet; any such charges will be deducted from the renter's security deposit.

The unit shall be left tidy and in order upon departure. In the event that special cleaning is required, or if any cleaning is required beyond what would be considered reasonable and customary, any such charges imposed by The Ocean Club management will be deducted from the renter's security deposit.

Cancellation Policy

The 50% rental fee deposit is fully refundable, upon documented notice of cancellation of a reservation, any time up to July 1st of the same year in which a rental week is booked for the following year. The same rental fee deposit is 50% refundable any time up to October 1st of the same year, and 25% refundable any time up to December 1st of the same year. No part of the rental fee deposit is refundable after December 1st of the same year.

The $350 security deposit is fully refundable any time that a reservation is cancelled.

Check-In and Check-Out

Check-in time is 4:00 PM on the agreed upon day of arrival, however most units are almost always ready for occupancy earlier in the afternoon. Check-out time is 10:00 AM on the agreed upon day of departure, unless prior arrangements have been made between the renter and The Ocean Club management. Any late check-out charges incurred by the renter(s) shall be the responsibility of the renter(s) at check-out time.

Safeguarding Valuables

In-wall safes are provided in our poolside villas. Safety deposit boxes are available at the Reception desk, however a fee may be imposed by The Ocean Club management for their use. Renters assume full responsibility for safeguarding their valuables at all times. We do not assume any responsibility for any of the renter's valuables, regardless of where they are kept, while the renter in possession of one of our rental units.

Conduct

It is the renter's responsibility to adhere to all Ocean Club rules and regulations. Renters shall not use our rental unit for illegal, immoral, or improper purpose, and are expected to not disrupt other guests at The Ocean Club. The Ocean Club management may evict any occupant for violation of its rules or policies. In the event that that should happen, renters are entitled to no compensation from us, and the renters shall be on their own to find other accommodations on the island for the duration of their stay.

Contract

This document will serve as the basis for a rental agreement, to be signed and dated at the bottom by both parties at the time of deposit / booking. Additionally, each preceding page of the rental agreement shall be initialized and dated by both parties at the time of deposit / booking.
