Article VII � IMPEACHMENT AND REMOVAL

Section 1.0 Procedures
1.1 Any elected or appointed officer of the SGA may be removed/impeached by the Senate.
1.2 A letter of formal notice of intent to remove/impeach an elected or appointed officer of the SGA must be presented to the Senate no less than one week before the vote is taken.
1.3 The same letter as mentioned above must also be given to the individual of concern and signed by the senator who is presenting the motion within the same time constraints as above.
1.4 A two-thirds vote of the entire Senate membership is necessary to remove a person from office.
1.5 Voting shall be by secret ballot.
1.6 This decision may be appealed directly to the Senate and by showing proper cause the person of concern can be reinstated to his or her position by two-thirds vote.

Section 3.0 The Hearing
3.1 The Senate shall serve as an impeachment hearing board.
3.2 The Senate member initiating the motion for impeachment shall present the reasons for his or her actions.
3.3 The accused shall have the opportunity to present a defense. He or she may also present witnesses or evidence for his or her defense.
3.4 All witnesses brought to testify before the Senate during the impeachment hearing shall pledge the following oath: I (name) affirm that I will tell the entire truth to the best of my knowledge.
3.5 The oath is given by the presiding officer of the Senate.

Section 4.0 Deliberation
4.1 Following the presentation of arguments, respectively, both for and against impeachment, the Senate shall then be allowed to question any evidence or witness that have been brought before them during the hearing.
4.2 The Senate shall then deliberate and vote.

Section 5.0 University Requirements
5.1 Within the first two weeks of each academic semester, every elected or appointed officer of the SGA must provide proof that he or she meets the requirements of the University for participation in extracurricular activities.
5.2 Should any elected or appointed officer of the SGA fail to meet University requirements, he or she shall be given notice of his or her removal from office.
5.3 The Senate will not be required to vote in such a situation.
