3.3 Tallying ballots 3.3.1 The Election Committee will tally all votes after the polls close. 3.3.2 The Vice-President and all Election Committee members present will sign a certificate of election which shall list all persons attaining an office in the election and shall immediately thereafter make the results public. 3.3.3 The candidate who receives a simple majority of votes cast, when the election is for a single space to be filled; (i.e. Executive Office) is elected. Simple majority is defined as %50 of votes cast plus one vote. 3.3.4 If there are two or more offices of the same character to be filled (i.e. Senator-at-Large) majority will be determined as follows: (Total number of votes cast) Number of positions open / 2 = Majority 3.3.5 If more candidates receive a majority than the necessary to fill the positions open, candidates with the most number of votes will be elected. 3.3.6 If no candidate receives a majority, a run-off election will be held one week following the general election. -If a run-off election is needed to fill only one vacant post, the two candidates receiving the most votes shall be declared candidates in the run-off election. -If a run-off election is needed to fill two or more offices of the same character, number of candidates in the run-of election will be equal to twice the number of positions open after the general election. 3.3.7 If, after filings close, the number of candidates for any office does not exceed that office, the candidates will be declared unopposed and the winners. Their name will not appear on the ballot. 3.3.8 The number of Homecoming Court participants will not exceed ten unless a tie in the tenth position should occur. Those candidates tied in 10th position may all be members of the Homecoming Court. 3.3.9 There will be no run-off for Homecoming Court positions. Section 4.0 - Violations 4.1 Reporting violations. 4.1.1 Any student who wishes to report an alleged violation of the Election Code must do so by filing a written account with the Vice President, Commissioner of Elections, and the Dean of Students within one class day of the occurrence of the alleged violation. 4.1.2 All complaints must be accompanied by the signature of the complaining party to assure the accused the right to confront their accusers. 4.2. Penalties. 4.2.1 Any breach of the Election code or additional rules which the Election committee deems necessary will subject the violator to penalty. The election Committee will reserve the right to use its discretion in the interpretation of this Election Code. 4.2.2 The Election Committee shall make consistent decisions regarding the penalties levied on accordance with the severity of the violation. Action may consist of a warning, restriction of campaigning, limiting expenses, or disqualification. 4.2.3 Failure of a candidate to comply with the ruling of the Election Board will result in the forfeiture of his/her right to ever hold any election position on Student Government or any Honor Court position. 4.2.4 All candidates are responsible at all times for their conduct during the campaign to the Vice-President of Student Affairs. 4.3 Appeals 4.3.1 The Supreme Court shall have appellate jurisdiction in all decisions made by the Election Committee. The appeal must be made within one class day of the Election Committee decision. 4.4 Contested Elections 4.4.1 Any candidate may contest the election results (counting of votes) within two days of posting by notifying the Vice-President, Vice President of Student Affairs, and the Chairman of Elections in writing. 4.4.2 The Election committee or the Supreme Court, when confronted with a contested election, may order a recount if deemed necessary or a new election if, it is the only course of action which will ensure a fair result.
