| Black Harbour Bullmastiffs Pet Contract Agreement for Sale of Dog This agreement is made, and hereby entered into, on this ____ day of _________, 2000 By and between (hereafter referred to as "Seller"), And (hereafter referred to as "Buyer"), for the purpose of setting forth the terms and conditions of the purchase by the Buyer of a purebred Bullmastiff dog. 1. _____ Seller agrees to sell & Buyer agrees to purchase a Bullmastiff dog (the dog") described as: Name: Breed : BULLMASTIFF Color: Sex: Born : Sire: Dam: 2. _____ Ownership of the puppy shall be transferred to the Buyer for the sale price of $_ _.00, to be paid in full on or before the day of . 2000. Only after the full amount of the agreed is paid, may the puppy be removed from the Seller's premises. If the balance is left unpaid by such date as of the day of . 2000, this agreement shall be cancelled at the Seller's option and the Buyer shall forfeit the deposit given hereunder. 3. _____ The Seller warrants that the above described puppy is in good health and free from communicable diseases at the time the Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian within 72 hours (not including weekends or holidays) of the receipt of the puppy. (Not applicable if Buyer is in attendance of puppy's vaccination and health check on the day of release.) If, as a result of the examination, the Veterinarian determines that the puppy is not in good health, then the Buyer shall elect to keep the puppy or return to the Seller for a refund. If the Buyer elects to return the puppy, the Buyer shall within 10 days after the date of the signing of this contract, send to the Seller, by certified mail, a written Veterinarian's certificate stating that the puppy is in ill health when examined. Upon receipt of the puppy, the Seller shall be obligated to refund all monies received from the Buyer toward the purchase of the puppy, and further performance under this contract shall be null and void. All action taken to return the puppy shall be with the best interest of the puppy in mind, including temperature at time of shipment, non-stop flight's, etc. 3. _____ The Buyer is completely satisfied and waives any and all claims regarding the puppy's conformation and outward appearance. (Thus meaning that the puppy is of the Bullmastiff Breed Standard set forth by the CKC at this age.) 4. _____ The Buyer agrees to maintain preventative health care of the puppy including, but not limited to: innoculations, internal as well as external parasites, heartworm preventative medication. 5. _____ The Buyer agrees to maintain preventative care of the puppy in regards to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (i.e. not allowing the puppy to jump from heights taller than itself at the shoulder, no forced exercise such as running, until at least 18 months of age.) 6. _____ If the puppy is being sold as Pet Quality, the Buyer agrees to have the puppy spay/neutered by the time it is of at least 6 months old and no later than 7 months. And upon receipt of the certificate of spay/neuter, the Seller will then forward to the Buyer the CKC registration papers. Should the Buyer not see to meeting this section of the agreement, the Seller may then execute the right to repossess the puppy without refund of any monies paid to the Seller. 7. _____ If the puppy is diagnosed with crippling Hip/Elbow Dysplasia and has to be euthanized, the Seller agrees to provide a full refund to the Buyer if it is proven to be 100% hereditary by both the Buyer's and the Seller's Veterinarians, or by the Orthopedic Foundation for Animals (OFA). 8. _____ The Buyer agrees that he/she shall enroll in and COMPLETE Basic Obedience Training. (This is to ensure that the puppy is properly trained and well socialized.) Buyer shall submit to Seller documentary proof of completion of Basic Obedience Training before Providing registration papers. 9. _____ The Buyer agrees that any future sale or placement of the dog shall include a provision binding the new owner to the terms of this contract. Buyer further agrees that Seller shall have a right of first refusal should Buyer decide to sell or place the dog. 10. _____ The Buyer agrees that the Seller may repossess the animal upon evidence of neglect and/or abuse at no expense to the Seller, and no refund of any monies. 11. _____ The Buyer agrees that the puppy will reside at the home of the Buyer, and have access to a fenced yard, and not be chained or "tied out". (See section 14). This animal is sold with the understanding that it was to go select homes, socialized properly, and become a member of the family. 12. _____ Buyer shall supply to Seller photographs of the dog taken at the ages of 6 months, 12 months, and 24 months. These photographs shall be supplied to the Seller within 1 month from the date photographs are taken. This agreement is made and signed by both parties to insure the well being and protection of this Animal and the reputation and ethics of Black Harbour Bullmastiffs. If any part of this agreement is breached, the Seller is released from any further obligations hereunder. If litigation is necessary to enforce any of the provisions of this Agreement, the prevailing party shall be entitled to all reasonable costs of engaging in such litigation, including reasonable attorney fees. If any portion of this Agreement is found by a court of competent jurisdiction to be illegal or otherwise unenforceable at law, all other provisions shall remain in full force and effect. |
