- I have been retained by Randy
Lachance to take whatever legal action is necessary to
-
- (a).....obtain
the Honda parts so that his vehicle can be repaired;
and
- (b).....recover
damages for the use of his motorcycle through your
failure
- to repair the motorcycle
within a reasonable period of time subsequent
- to April 12
2001.

- I am advised by Mr. Lachance that
his insurance company has at all times been willing to
pay
- fully for the repair of the
vehicle. As you are no doubt aware, the motorcycle was damaged
as
- a result of an accident which was
the fault of the other driver who was charged with breach
of
- the law at the time by the
investigating officer.

- Mr. Lachance's damages are
accumulating monthly because he has had to make
monthly
- motorcycle payments and equally
significant pay insurance charges during the period in
which
- he has not had the use of this
vehicle.

- On May 25, 2001 Mr. Lachance was
advised that his motorcycle was repaired, but he was
- notified that there was an oil
leak which "might seal up once it warms up". After only a
few
- hours of use Mr. Lachance
returned the motorcycle because the oil that was leaking
was
- leaking onto the tire thereby
causing dangerous conditions in operation.

- Finally on June 15, 2001, the
motorcycle was not repaired and he took it to another shop
to
- have the repair effected. The
required part was still not available through Honda and
the
- Honda Canada representative
suggested that Mr. Lachance take the motorcycle to
another
- Honda Dealer.

- It is now nearly 6 months since
the accident and despite Mr. Lachance's purchase of a
brand
- new bike he has not been able to
obtain a replacement part from Honda.

- If we do not hear from your
office within 10 days of the receipt by you of this letter with
an
- offer to provide satisfaction, we
will have no alternative but to commence an action.
