ANDERSON PETITION

TO THE HONORABLE JUDGE PRESIDING OF THE SECOND JUDICIAL DISTRICT COURT, HOLDING SESSIONS IN AND FOR BIENVILLE PARISH, LOUISIANA. THE PETITION OF MRS. PEARLIE A. SMITH, MRS. GLENNIE J. JIMMERSON AND MILO E. ANDERSON, with respect represents:

1. That they are all residents of Bienville Parish, Louisiana.

2. That T. F. Anderson is a resident of Bienville Parish.

3. That J. T. Anderson, Prather N. Anderson, Sallie Louise Anderson and Billie Eugene Anderson are residents of Bienville Parish and are all minors.

4. That T. F. Anderson has been and is now the only appointed and qualified natural tutor for said minors.

5. That Vera Renfrow Cowart, Lorene Renfrow Clardy, Marjorie Renfrow, Jesse Renfrow and Louie Renfrow are all residents of La Salle Parish, Louisiana.

6. That Steve Renfrow, a resident of La Salle Parish, Louisiana, is the duly appointed and qualified and confirmed Natural Tutor for the minors named in paragraph �5� above.

7. That Floy Smith is a resident of Bienville Parish and is a minor and that her father, W. Clay Smith, a resident of Bienville Parish, Louisiana, has been duly appointed and qualified as her Natural Tutor.

8. That Petitioners and T. F. Anderson, J. T. Anderson, Prather N. Anderson, Sallie Louise Anderson and Billie Anderson; and Vera Renfrow Cowart, Lorene Renfrow Clardy, Margie (Marjorie) Renfrow, Jesse Renfrow, Louie Renfrow; and Floy Smith, are the owners in indivision of Three Hundred Sixty and No/100 (360.00) Dollars on deposit in the First Natoinal Bank in Arcadia, which deposit is in the name of T. J. and T. F. Anderson, or T. F. and T. J. Anderson.

9. That said money is owned by the above named parties in the following proportions, to wit:

10. That said parties own said money in indivision in the following proportions, to-wit:

T. F. Anderson, owns 5/8 of same.

Vera Renfrow Cowart, Lorene Renfrow Clardy, Margy or Marjorie Renfrow, Jesse Renfrow, Louie Renfrow and Floy Smith, 1/24 each.

Mrs. Pearlie A. Smith, Mrs. Glennie J. Jimmerson, Milo E. Anderson, J. T. Anderson, Prather N. Anderson, Sallie Louise Anderson and Billie Eugene Anderson 1/56 each.

11. That the above named parties become the owners of said money or property in the following manner, to-wit:

That all of said money is the proceeds received from renewals or rentals paid on an oil and gas lease in order to keep same in effect without drilling, and covers land owned by T. J. Anderson and T. F. Anderson, share and share alike.

12. That there was born of the marriage of T. J. Anderson and his wife, Mrs. Sallie Martin Anderson, two children, to-wit: T. F. Anderson and Mrs. Lena Anderson Renfrow.

13. Mrs. Sallie Martin Anderson died leaving T. F. Anderson and Mrs. Lena Anderson Renfrow as her sole and only heirs.

14. At the death of the said Mrs. Sallie Martin Anderson, the property standing in the name of T. J. Anderson, became the property of T. J. Anderson 1/2 and to T. F. Anderson and Mrs. Lena Anderson Renfrow 1/4 each.

15. That Mrs. Lena Anderson Renfrow sold her interest inherited from her mother, Mrs. Sallie Martin Anderson, to T. F. Anderson, all of which will more fully appear from the deed as recorded in Book �59� page 507 of the Conveyance Records of Bienville Parish, Louisiana, which deed as recorded is made part hereof by reference.

16. After T. F. Anderson purchased the interest of Mrs. Lena Anderson Renfrow in the estate of her mother, the land became the property of T. J. and T. F. Anderson in the proportion of 1/2 to each.

17. The land was then leased for oil and gas and other minerals by T. J. and T. F. Anderson and the money now deposited in the First National Bank was paid as renewal or rental on said lease.

18. At the time T. F. Anderson acquired the interest of Mrs. Lena Anderson in her mothers succession his wife was (ailing?) and she died leaving Mrs. Pearlie A. Smith, Mrs. Glennie J. Jimmerson, Milo E. Anderson, J.T. Anderson, Prather N. Anderson, Sallie Louise Anderson, and Billie Eugene Anderson, as her sole and only heirs, all of which will more fuly appear from the papers in the matter of the Succession of their Mother made part hereof by reference.

19. Mrs. Lena Anderson Renfrow died leaving as her sole and only heirs Mrs. Vera Renfrow Cowart, Mrs. Lorene Clardy, Margie Renfrow, Jesse Renfrow, Louie Renfrow, and Mrs. Eva Renfrow Smith.

20. Mrs. Eva Renfrow Smith died and left one child, Floy Smith, a minor, as her sole and only heir.

21. That T. J. Anderson died on or about September 9, 1936, and left as his sole and only heirs, T. F. Anderson and the children and only heirs of Mrs. Lena Anderson Renfrow as above mentioned.

22.That petitioners are unwilling to hold said money longer in indivision.

23. That said parties above mentioned should be recognized and sent into possession of all the property left by the said T. J. Anderson at his death in the property above described., as owners in the proportions above mentioned, as his sole and only heirs.

24. That a rule should issue to the Sheriff and tax collector in and for Bienville Parish directing and commanding him to show cause if any he may have why the said estate should not be decreed to own no inheritance tax and be free from the payment of same.

25. That the estate of the said T. J. Anderson owes no inheritance Tax and should be so decreed.

26. That said money should be turned over to H. Rupert Sledge, Clerk of the Court in and for Bienville parish to make and partition same as order by this Honorable court.

27. That the First National Bank of Arcadia should be ordered to pay said money over to him to be partitioned as the law directs, and that the said Bank has said money in its bank, and should be made a party to this suit for that purpose only.

28. That H. L. Williams, Attorney for / filing this suit and obtaining a partition hereof should be allowed a fee of Seventy Five Dollars, which amount is reasonable for the work required to be done in this suit, and same should be assessed as cost and paid from the mass herein.

WHEREFORE, premises considered, petitioner prays for service and citation hereof, according to law, on T. F. Anderson, individually, and as natural tutors for the minors, J. T. Anderson, Prather N. Anderson, Sallie Louise Anderson, and Billie Eugene Anderson.

Prays for service and citation hereof, according to law, on Mrs. Vera Renfrow Cowart, Mrs. Lorene Clardy and Jesse Renfrow, and on Steve Renfrow, as natural Tutor for the minors, Louie Renfrow and Margie Renfrow.

Prays for service and citation hereof, according to law, on Floy Smith through her tutor W. Clay Smith.

That service and citation hereof be made on the first National Bank in Arcadia, a corporation organized under the laws of the United States of America.

That a rule issue herein directed to Henderson Jordan, Sheriff and tax collector in and for Bienville Parish, Louisiana, ordering and commanding him to show cause, if any he may have, why teh estate or property above mentioned as belonging to T. J. Anderson, deceased should not be decreed to own no inheritance tax and be free from the payment of any. That said estate be decreed to owe no inheritance tax and free from the payment of same.

That on final trial hereof, petitioners and the above named defendant be decreed to be the owners of the said money deposited in the First National Bank of Arcadia in the proportions as above alleged and that a partition thereof be ordered made in accordance with law; that the First National Bank in Arcadia be ordered to turn said deposit over to H. Rupert Sledge, Clerk of the Court in and for Bienville Parish, for the purpose of partition, and that he pay same out as follows, to-wit:

1. Pay all cost of this suit and of the partition.

2. Pay R. L. Williams, Attorney, $75.00.

3. Pay the balance out as follows: T. F. Anderson, 5/8; Pay Mrs. Pearlie A. Smith, Mrs. Glennie J. Jimmerson, Milo E. Anderson, Prather N. Anderson, J.T. Anderson, Sallie Louise Anderson, and Billie Eugene Anderson 1/56 each; Pay to Vera Cowart, Mrs. Lorene Renfrow, Jesse Renfrow, Louie Renfrow, Margie Renfrow and Floy Smith 1/24 each.

Prays that a fee of Seventy five dollars be allowed R. L. Williams as aboved alleged.

Prays for cost, all orders and decree necessary and for general relief.

ORDER

By reason of the law, the foregoing petition and affidavit, Henderson Jordan, Sheriff and Tax Collector in and for Bienville Parish, is hereby ordered to show cause, if any he can, on Tuesday, September 19, 1939, why the estate and succession of T. J. Anderson should not be decreed to owe no further inheritance tax and be free from payment of same. Thus done and signed officially on this the 5 day of Sept. 1939.
