CONCLUSION

The State and Government of Goa, even though having no constitutional competency have carried out so called amendments to the unauthentic/unofficial English version of the Code of Comunidades with an intention to destroy the very foundation of Comunidades by keeping the Gaunkars/Comunidades under bondage. The State by committing the said illegal acts of so called amending the Code, the wrongful act of land acquisition, the acts of wrongful imposition of land reforms, providing incompetent Administrators and other staff, crippling of the powers of the Administrative Tribunal, abdication of authority and powers by the Governor of Goa, etc., has thereby committed and is progressively committing ethnocide, institutional and cultural genocide of Gaunkars and Comunidades of Goa, plundering, displacing, dispersing and alienating the Gaunkars from their lands, forcing them to take refuge elsewhere. The State has further destroyed the foundation of the Goan economy by crippling agriculture and destroying the ecology thus making Gaunkars and Goans increasingly dependent on politicians, powerful industrialists and business lobbies.

The Government should have declared Comunidades of Goa, �National Heritage of India� being the only institutions in existence since Vedic India. The Ancient Hindu Jurisprudence by M. S. Pandit refers to the Associations of Ancient India, which made rules for themselves (such as Samaya and Samvid) and not by the State, with the understanding that the King/Ruler functioning as the Supreme Arbitrator to decide over disputes and breach of contracts. The Administration of Comunidades as per Code of Comunidades is highly influenced by Kautilya�s Arthasastra, to give timely compliance. The State has committed gross atrocities and criminal breach of trust against the Gaunkars for the benefit of selfish and corrupt politicians through both - Centre and State Governments, after so-called liberation of Goa from Portuguese rule. The liberation of Gaunkars and Comunidades can only take place when western influence of laws contrary to the basic structure of the Gaunkary is removed from the present Code of 1961, when the land wrongly acquired by the State is restored to its original position and when the State honours the Contract made with the Gaunkars of Goa to comply with the provisions of the Code of Comunidades.

What Mahatma Gandhi had envisioned in India of My Dreams for local self-governance, are the very institutions in the form of Gaunkaries which were prevailing throughout the Indian sub-continent (Bharat) and abolished on account of progressive invasions from outside. Had Gandhiji to live longer, he would have certainly learnt that there is such an ancient Indian institution of his vision known as Comunidades still struggling for survival in the territory of Goa and would have never allowed the Gaunkars to be crushed or held bondage at the whims and fancies of the political leaders.
