SECTION 27-18. BURNING - SPECIFIC ITEMS PROHIBITED.

Burning of garbage, rubber, plastics, leather, dead animals, bedding, furniture and trash containing garbage, such as food cans, bottles disposable diapers, is prohibited within the corporate limits of the City of Nevada, Missouri.

SECTION 27-19. BURNING - SMOKE OR ODOR PROHIBITED - EXCEPTIONS.

Except as herein provided, any other burning, such as animal, vegetable or other substances, the burning of which creates or generates any disagreeable smoke, noxious or unwholesome odor, is prohibited.

   a. Burning leaves. The City Manager or his designee will annually designate at least a two (2) week period in the fall and a two week period in the spring during which the burning of limbs, brush, leaves and yard debris will be allowed. Additionally, specific permits for burning of leaves and yard debris will be permitted by the Fire Chief, or his designee on duty at the Fire Department, by telephone request, assuming wind and moisture conditions at the time of the request or said burning are such that burning, supervised by the applicant, should not create a hazard to property and person. Any authorized burning which in any manner creates a hazard to the property or person of another is prohibited and shall be punished in accordance with the general penalty provision of the Code of the City of Nevada.
   b. Burning of household trash. Household paper trash may be burned within the corporate limits of the City of Nevada, Missouri, so long as the burning does not create or generate any disagreeable smoke, flying ash, noxious or unwholesome odor. Fire shall be constantly attended by a competent person until such fire is extinguished.
   c. Business, commercial or trade waste - Use of incinerators. Incinerators which have met the performance test and received approval from the staff director of the Missouri Air Conservation Commission, as is required in out-state Missouri under 10 code of State Regulations 10-3.40, may be utilized for burning commercial or trade refuse within the City limits of the City of Nevada, Missouri, to the extent permitted by the regulations promulgated by the Air Conservation Commission as authorized by Section 203.050, RSMo., 1978. Any use of an incinerator not approved, or the use of an approved incinerator for a purpose not authorized under Chapter 203, RSMo., 1978 or the regulations promulgated pursuant thereto, will be referred to the County Prosecutor for prosecution under the State Laws and regulations.

SECTION 27-20.  METHOD OF BURNING
   Burning of trash, lumber, leaves or other combustible material in any manner that creates a hazard to the property or person of another is prohibited. A water hose connected to a water supply or a fire extinguisher shall be available at the specific locations where any burning of combustible material will occur. (Ord. No. 3480, ss 1-3; Ord.
