According to RFVideo.com, a lot of people backstage are pushing Vince McMahon to deal with Goldberg. The only problem is that Goldberg would have to accept a buyout of his Time Warner contract, which is worth over $7 million and lasts for a little over two years. As reported before, Goldberg is more than happy to sit out the rest of his contract and collect that money while either taking it easy or working on his acting career. It is possible that Vince could buy his contract from Time Warner, although Goldberg's contract might be non- transferable meaning that Goldberg would have to agree to letting Vince buy his contract. Many of the top WCW guys have non- transferable contracts. Vince also seems completely unwilling to accept the terms of any Time Warner contract as he wants them all renegotiated with WWF terms. The best man for the wedding is none other than Adam Copeland (AKA Edge). (Congrats to Christian from nWN!) -The WWF have cancelled it's June 30 scheduled house show at the Cow Palace. No information has been provided as to why the show was cancelled, nor has ticket refund information. -The WWF website is reporting Triple H's surgery to repair his torn left quadricep muscle was successful. Helmsley had the surgery on Thursday and is currently recovering at his home. He is projected to return to in-ring action in six months. -Featured on New York's UPN 9 News, D-Von Dudley, Terri Runnels, and Steven Richards were on hand to meet, greet, and eat with the officers of the United States Navy on the USS John F. Sunday night, in the 11- 1am ET timeslot, Darryl Peterson (aka Maxx Payne & Man Mountain Rock) will return to the program. -Smackdown didn't hold the record for highest rating in UPN history. The debut of Voyager held the record, which may or may not have been broken last night. -Last night's edition of Smackdown did a 5.0 overnight broadcast rating, up from last week's 4.9. The WWF led UPN to a fourth place finish in the nightly ratings race, trailing NBC (8.5), CBS (8.3) and ABC (5.7). They beat Fox (3.8) and the WB (3.0). The fact that the number rose slightly is a good sign, but it probably could have risen more. With the Spring TV season over, all of the heavy duty competition that Smackdown has faced since January is largely either gone or in repeats. -There are a lot of rumors that the WWF is pushing hard to sign more names from the old WCW. Some people are saying to expect WCW people on TV this week. Good luck bidding and Teri looks forward to meeting the winner one-on- one! ====================================================================== Article//============================================================= WWF vs PTC Ruling A motion filed by the PTC and verbally argued on April 26 to dismiss the lawsuit filed by WWFE was denied today in U.S. District Court for the Southern District of New York. All counts attempting dismissal by both the PTC and James Lewis were denied in today's ruling by U.S. District Judge Denny Chin. The basics of the ruling is that the free speech protection because WWFE as a public entity (like a public figure) makes it harder to libel than a private individual, however, some of that protection is removed because the statements were made for fund raising purposes, thus what the PTC stated could be regarded as commercial speech as opposed to public speech or reporting. The WWF itself conceded the company would fall into the "public figure" category, so they must prove in the lawsuit that the statements made by the PTC would be understood by an ordinary person to be defamatory, be provably false and wer stated by people with knowledge that they were false and were recklessly disregarding the truth. The crux of the lawsuit is whether the WWF can prove Bozell knew that wrestling and WWF had nothing to do with the deaths of the four children but claimed it anyway, and probably the Tate case more than the other three. They are also going to attempt to prove tortious interference in a contract as it pertained by attempts to get ConAgra and MCI Worldcom to stop sponsoring Smackdown. To prove that, they have to prove the statements said that caused those companies to pull out were to interfere with the contract (undeniable truth) and knowingly false (like in all cases, the crux of the lawsuit). It has to be both. In suing, WWF has to show the defendants damaged the company monetarily, and sponsors pulling out does satisfy that requirement. Tate's attorney, James Lewis, was unable to get himself dismissed as a victim for numerous reasons, the key one being his participation in the PTC fundraising video where he allgedly defamed WWFE as well as on radio and television programs that went beyond him trying to defend Tate such as "Dateline" and "Leeza." A pre-trial conference with both sides has been called for 6/22.
